FACT: THE NI ACT 138 CASE HAS BEEN FILED AGAINST THE COLLEGE SOCIETY AND THE DIRECTORS FROM A1 TO A7 IN THE YEAR 2007.THE CASE HAS DISMISSED AGAINST THE ACCUSED PERSONS A4,A5,A7 IN THE YEAR 2016 AS THE REASONS STATED BY THE HON'BLE JUDGE THAT THE COMPLAINANT NOT FILED PROCESS SINCE LONG TIME.THEN AFTER FEW MONTHS THE HON'BLE JUDGE TAKEN STEPS DIRECTLY TO COMPLY SECTION 235(2)OF CR.P.C AGAINST THE ACCUSED PERSONS A1, A2,A3,A6 AND HERE THE COMPLAINANT ALSO NOT APPEARING SINCE THREE CONSECUTIVE DATES ANT NOT REPRESENTING THE CASE PROPERLY .THE CHEQUE ORIGINALLY MANIPULATED THE DATE BY OVER WRITING THE MONTH DIGIT .

Q1. AT THIS STAGE CAN WE FILE EVIDENCE ACT SECTION 45 PETITION TO SEND THE ORIGINAL CHEQUE TO THE EXPERT OPINION.

Under suspension for last 10 months

I was posted as BM in a public sector bank and during that period few loan were processed and sanction which had some irregularities. However by followup these loans were closed but the bank has taken up these cases as fraud and FIR against the BM is lodged even though the borrower have agreed having taken the loan. Please advise the fate of the FIR and guide for future course of action. Moreover i was suspeneded in july2015 and no chargesheet has been served till date. I have the following queries
1. In FIR police has filed FR in the court which has been protestedby the bank. What will be the future course.
2. It has been 10 months of suspension and for the last two months substance allowance is not been creditedto my account however instalments of my loan are regularly deducted from my salary.
3. No chargesheet is been servedro me till date.
Please guide of the fate of the case and what steps available with me.

What to do against them

Dear sir, three real estate persons bought laln next to my fathers land of 101 cents. they developed plots and occupied 6 cents of my father's land.we have filed a civil case and still pending in the court. one of the real estate person built a house in the plot they developed.To threaten us this person with help of his wife gave a wrong complaint against me with help of a lawyer. the police filed a fir against me under IPC 499,500,503 and R-w 506. After investigation the police reported mistake of fact. they spoiled my name my father name in the society.due to this I left my job. what legal action can be taken against them.

Divorce

Hello All. One of my friends has done registered marriage in a small village of Maharashtra, however they both are from Mumbai. So will their marriage be considered legal. Also they have been living as bachelors and not been a single day together. It's been six months being married. But now the girl is saying she doesn't want to continue this marriage as her parents will not accept and will die. Can they both take a divorce by mutual consent. Also if in this case minimum 1 year is required to take a divorce. Please help. Thanks!

WHERE 'A' SOLD A PROPERTY AND MADE LONG TERM CAPITAL GAIN, HE DEPOSITED THE AMOUNT IN CAPITAL GAIN SCHEME ACCOUNT, BUT COULDN'T UTILISE THE SAME, SO IT BECAME TAXABLE AFTER 3 YEARS, HE TOOK A LOAN AGAINST SUCH AMOUNT DEPOSITED, WHICH IS NOT PERMITTED BUT HE SOMEHOW DID, SO IS THE EXEMPTION WITHDRAWN BY SUCH ACT.???

Payment of gratuity

Sir,

I had served in a Registered Public Charitable NGO Hospital for 6.2 months (Apr.2010 to May, 2016). My age at the time of joining the service was 55 years and in view of advanced age factor, I was not offered PF, ESI facilities except allowing leave facility as is offered to other employees of the institution.

I shall be grateful for clarifying me as to whether I am eligible to claim Gratuity for the period of service rendered i.e. 6 years as per Gratuity Act, Andhra Pradesh, India.

Look forward to receiving your suitable reply that not only helps me to have invaluable financial support at this point of age but also pave the other employees rendered service in the institution for over last more than 1 1/2 decades.
