Whether in a complaint petition in Judicial Magistrate court, a falsely implicated accused person can file any petition such as protest petition ,revision petition or any in the same very court or else where other than High Court u/s 482 for quashing the court proceeding ?

Transfer of case

Sir,
I have filed a petition for getting maintenance for me and my 2.4 yr old daughter in my hometown. mediation section is going on. meanwhile husband filed a child custody petition at his work place which is 342 kms away from my place. Is it possible to transfer that case to my hometown..? coz travelling to such a long distance with baby is difficult and lso financial problem is there.

Application for final decree pursuant to preliminary decree

Sir,

I filed application for final decree along with application for advocate commission for demarcating the property by metes and bound. Unfortunately due to non appearance of my counsel the application is dismissed and at the same time the opposite party counsel also disappeared from the case.

I want to know whether an application for execution of preliminary decree for final decree is treated as an Interlocutory application or it will be treated an application reminding/requesting to the court for execution of decree and not for adjudication.If the same is outside the purview of adjudication why it is dismissed in default. How much time is granted to a decree holder for condonation to restore the same. Please kindly offer your advise as I am in doubt.

How to cancel a development contract

Hi experts. Need your expertise on an issue. I own a house in which I've been residing since about 30yrs. Recently I came in contact with a developer who insisted on developing my property. I have a mortgage on the house and in the pressure to vlear my debts i agreed. They gave me a token amount which is not even 5% of my property value and asked me to write a reciept. In the reciept i mentioned my name,fathers name,location of my property and also they asked me to sell me terrace rights so i wrote that I agree to sell my terrace rights to the developer. Later i found out that the builder has a bad reputation. and i immediately went to him the next day with his money but he refused to take it back. He threatened me saying that he wont let go of my property. I am in a need of money and I'm willing to sell my property instead of developing it. Kindly advise me what to do in this troublesome time I'm going through. I want to sell my property but I'm 90% sure that this developer will bring hurdles if i try to do so. Request you to help me out. Thanks

Land owner not returning money

Respected Sir,

We wished to buy property from a agri land owner in Maharashtra for which we paid 15% of amount via cheque as advance and made notarised document (sathe khat) where he promised to get all the required signature of family numbers (land is ancetral owned now by land owner, his two sisters and a cousin sister).
His cousin sister is not ready to sign but rest all are ready to sign the sale document. On coming to know this we demanded money back but he is not responding now.

1. He is ready to give his legal share of land (property division document not yet made among them) to us but will it be possible to take his share of land without his cousin sisters signature?

2. Also how could we recover our money in case 1st option not works. I understand i will have to case in civil court. For that do i need to get Sathe Khat registered or notarised document is sufficient legal proof? Also generally how much time it takes for such cases to come to conclusion in court of law ?

Respondent time limit - high court - article 226 of constitution

Sir,

As an petitioner, if i file writ petition In under article 226 of the constitution, How much time, that court will give respondent, to file counter from day of receiving notice and from date of filling of vakalath in the court.

As i would like to file WP against Municipal corporation for not taking action against construction of illegal building.
