Cheating by builder

Hello Experts
Please help very frustrated

I have purchased resale flat in 2015. The project is still under construction and developer is maintaining all the buildings. Building handover or society formation process has not yet done. Last week builder called for handover meeting but some members including me denied to handover process. Project is under Gram Panchayat area. Collector NA order available.

Reasons for denial of handover are:
1) Developer breached number of agreed terms.
2) Total 430 flats no basic water source. No drinking water from 3 years.
3) NA order of 7 floors in our agreement but developed 9 floors. He told told he issued new revised sanctioned plan. But not showing us copy and not taken prior permission of residents for building extra 2 floors.
4) We some residents refused to society formation and asked him to do pending work and settle our issues then only we will give our consent. To take revenge he stopped the water supply of building and saying there is no water in well and no money to buy water tankers. But his construction is still going on.
5) Very very bad quality internal and external plumbing. After every next day plumbing pipe broke.
6) Water leakage in whole building daily hundreds of litres water is wasted but we don't have water in our flat.
7) At the time of booking he has taken advance 2 year's maintenance from all residents and it is written in agreement that he will transfer all that amount to society account at the time of formation. But now he is denying to give our money and saying that all the money is spend on society maintenance.
8) Very cheap quality lifts. Automatically stops any time.
9) In summer season no water is available in well due to which daily tankers are required. Monthly water tanker expenses are around 4 lakh rupees. Whole project is depend on government water canal.

I have send number of letters and legal notice through advocate regarding this issues and asked him to rectify the errors and leakage in my flat, but till now he not done anything. Very rude and inhuman man.

Now we 2 residents wish to return the flat to the developer and ask to refund as per todays government rate. Can we do?
Please tell me what remedy is available and action should be taken against him?

Thanks and regards

Yogesh

Not refunding return ticket

Hello I booked a return flight through online agent Goibibo. Outbound and inbound airlines are different. Outbound flight got cancelled due to poor weather so I was not able to use my inbound ticket as well. Therefore I called goibibo to either cancel or reschedule my both ticket but he said that he can't do anything as inbound ticket is different airline then outbound airline and I am the one who ask to cancel this flight so there will be no refund given. I want to know that in this case when I was forced to cancel my inbound flight due to outbound flight cancelled, can I get my full refund of inbound flight? I gave three option to goibibo
1. Cancel the inbound flight and refund full amount of both flight (Outbound refund is no issue).
2. Reschedule my both flights in upcoming weeks.
3. Cancel both flights and keep the money with you and I can use it for future travel booking.
But Goibibo is saying that if airline don't give refund so they can't do anything.
I understand weather condition is not the airline fault but it is not customer fault either. Why only customer have to take all the hit why not Goibibo is responsible? Airlines were different for both flights but my agent is same for both flights. Please advice.

Certificate of practice

myself an practising advocate since last 14 years continually in civil as well as taxation. I am also member of district taxation bar as well as district bar association since enroll with bar council Punjab Haryana District bar association also allotted me a chamber in district court in 2005. Till then the chamber is in my use. But I did not use it much frequently. But being I do my main practice in taxation so that I did not plead any suit in civil court simultaneously my name was also stuck by bar association since many years due to non payment of member subscription.
Now they forfeited my chamber on account of non practising advocate.
My question is this that wheater taxation practise is not a practice.
If yes from where I could get my so long practice certificate. .
When I approached taxation bar they denied by saying that they are not registered bar hence can't. While main bar association arguged that u didn't paid our membership subscription nor practice in civil courts. .
Pls suggest what should I have to do.

Valuable guidance to get the pending cases disposed at high court

Dear Sir,
My father filed WP Nos 15431, 15727, 18397 of 2014& 28635/2015, before the Hon’ble High Court at Hyderabad. The matter of fact is that he was allocated dealer ship of HPCL Retail fuel outlet by the Hindustan petroleum corporation ltd and was in need of NOC from the District Collectors Office.

After getting N.O.C from all the relevant departments as ordered by the District Collectorate, the district collector alone was causing delay in granting the final NOC to establish the retail outlet. The WPs which got filed in the year 2013 was disposed of and the District Collector deliberately raised some other objections with intent not to grant NOC. Due to which again my father was to file WPs as stated above. Presently all the 4 WPS are pending and they all are in admission stage. It’s more than 3 and half years, since my father’s matters are pending before the Hon’ble High Court and as such there is no relief.

As per the present progress of the cases, my father is most worried that the cases might prolong even after his life and he is aged around 75 years. Further he suspects whether the cases would be settled during his lifetime or not. Since the matter is well known to him and he wishes that if the cases are expedited and the cases are disposed as early as possible.

In the present situation, can my father file petition before the Hon’ble Supreme Court of India to give a direction to the hon'ble High Court of Judicature at Hyderabad for the states of Andhra Pradesh & Telangana to dispose the above said wps as expeditiously as possible. or After reviewing the above circumstances, I request your good self to suggest me some valuable guidance to get the out come from the wps of hon'ble high court as early as possible.

Thanking you Sir,

With regards,
-Moinuddin
