Dear sir,
I heartly request you and need help regarding my query
Sir I had kept one vehicle in garage for repair work but unfortunately my father had a brain stroke and was admitted in ICU in the hospital and could not look after my vehicle but after some month when I went to the garage I found that my vehicle was thrown outside the garage and major parts of the vehicle was stolen and even some guys were opening the engine of my vehicle which I later found was the staff of the owner of the garage I immediately directed them to hand over the vehicle in my possession as I would not repair the vehicle in their garage further directed them to provide me the lost parts of my vehicle but the garage owner instead of feeling guilty is directing me to provide him with rent for keeping my vehicle in his garage for time specified and he is further directing me that the vehicle shall be released only on such condition as specified by him but my vehicle is in open shed and completely damaged sir how should I bring back the vehicle to my custody as they are continuously stealing parts of my vehicle the vehicle is also completely damaged sir please provide me with help as I am financially not strong and it is the only source of my livelihood

Good evening experts:
I am a lawyer defending one of the respondents (husband) in a proceeding for divorce filed against him before the Family Court by his wife. The application of my client to seek the leave of the court to engage me as his lawyer was allowed by the family court. Thereafter, the respondent appeared personally with me and we filed the written statement and also the reply to the interim application for child custody under Section 26 HMA. The court then posted the matter to the next date for mediation and framing of issues. The respondent then did not appear on the next date which was fixed for mediation/framing of issues, but I appeared for the respondent in the court, which is reflected in the order. The order specifically mentions that the counsel for the respondent is present before it. However, the court has proceeded ex parte against my client, stating that due to his non-appearance the mediation could not be conducted and thus there is delay in the disposal of the case. According to me such an order is palpably erroneous, which should be assailed under Article 227 of COI. Can the respondent be proceeded against ex parte if he does not appear for mediation/framing of issues, but his lawyer is present before the court? I would like to know the views of my ld.colleagues on this forum.
Thanks in anticipation

I had filed a suit for specific performance. The defendant filed an Application for Rejection of my suit under Order VII. My lawyer has replied to all the points by simply stating "That the contents of the para... are wrong and denied. It is denied that.. (repeating the language used by the defendant)". I have the answers to all the points of the defendant, but my lawyer says that the onus is on him to prove the points that he has raised and therefore his reply is correct. Is this the correct way of replying. I fear that my suit might be set aside. Kindly revert.
Partition agreement validity
Hi Sir,
I am Sunil from Bengaluru and my mother stays with me.
My mother signed partition agreement ( stamp paper of Rs 100 but not registered/ notarized and no witness signed ) around 5 Years back for her deceased mother property in Kerala.
Now, she does not want to comply with the agreement as she feels that property is not divided equally and wants to get equal share of ( 1/6 th ) which her younger brother is not agreeing with as he wants 2/6th share.
Kindly advise if the agreement has any legal sanctity.
Thanks,
Sunil
