Settlement deed among family members

I was living with my parents. Both my father and mother have died. The house in which we are living is in the name of my father who died without a will. Hence I applied for legal heirship certificate and the same will be received shortly from the thasildar. I have 1 brother and 2 sisters. My brother and one of my sister want relinquish their rights in the property and the other sister is some what reluctant and I also do not want to compel. Now can my brother and one of my sister can relinquish their right to property? How it should be brought into the document to be registered. Should I mention that we are four legal heirs and two of the legal heirs are relinquishing their share in respect of their brother. Is it enough if my brother and one of my sister, who is willing to relinquish sign the deed at the registar office. Is it necessary that the other sister, who is reluctant should also be taken to register office and the document should be written in such a way that she is not relinquishing her right.Pl. advise me.

Nuisance

I stay in a bungalow in a residential area. I have a neighbour staying in a bunglow opposite mine. The neighbour has sons who call thier friends all the time and keep sitting at the corner and creating noise. Chit chatting , shouting, abusing , all things that college going brats do. I have still been tolerant. They have also used firecrackers many times but i have tolerated. Now, there is a situation that whether the neighnours kids are around or not, there is always a bunch of boys sitting there. One goes , another comes. Recently they telecasted a match using projector and screen on the road , on the corner. What action should i take to stop this. With respect to firecrackers burst in the afternoon , with respect to match telecast and if possible restricting the number of boys collecting there. Many of the boys stay in the same lane but not my corner. My important questions are -
1. Is it allowed to stand on the road each day like this .. almost more than 10 boys.
2. Are they allowed to collect at a place like that and chit chat , if they are not causing nuisance like fire crackers and all.
My concern is that I don't want my corner to become a hooligan spot where they are always standing. It becomes awkward for the women to even move around as always they are there.

Family debt problem for the last 13 years please help me

Respected Madam / Sir,

My name is sandeep and I'm from Tamilnadu.


I have a difficult and tough situation which requires help from experts like you.

My father and mother currently separated and I have one younger brother. My younger brother is addicted alcoholic drinking. My father retired from his duty and now he is working with one part-time job with salary of Rs 3,000. We have a small land which is (1200 sq.feet) .The problem is my mother borrowed more than 10 Laksh rupees from different local peoples and the total amount is now 14 lakhs rupees including interest. My mother not listening any one and still she is borrowing money from peoples by telling lie (for my hospitalzitaiton/ brother health problem/...etc).

My mother not signed any bond or any legal document for the borrowed money till date.

I'm trying to clear the debt money by selling that 1200 sq. feet land which is currently in my mother name. This property my mother got it from his father by court order.


Now I have some legal question to answer to sort out this problem.

1. By selling this land at least I need 3 to 6 months time and I need my mother co-operation. Mean while if any one filled civil case against my mother will it affect me, my father and brother. If so what action i have to follow?


2. My father is having some land (1 acre) which he got from his father (my grandpa). If any one filled legal case / went to police case will it affect my father property?


3. Finally most important as an elder kid I'm trying my level best to convenience my mother to understand the debt problem but she is not doing. Due to this family life also get suffered.


Currently I'm working as a Software Engineer in Top MNC in Chennai.

What will be the correct option I can choose?

Requesting Madam / Sir, Please help me Your best suggestion will help to save one family.

Unfair name added to my property

Dear Sir,
My mother passed away two years ago. She had the registration of the land and house in her own name from the beginning, the house in which we live. Before passing away she declared her last will which is perfectly executed and witnessed but it is unregistered. She declared clearly that this property will be partially transferred in to my and my sister's name. My deceased elder brother's wife has bribed the municipality and the officer has ordered to put her name on the property along with me and denied to add my sister's name. I've gone against this decision in session court but my lawyer is neither clarifying anything nor telling any progress. what should I do now and how should I do it, please guide me sir.

Power of attorney

While availing a home loan from a Bank 4 of us created a mortgage.The loan has been fully paid.My 3 sons who executed the mortgage are not in town.The Bank has to release the mortgage for which they require presence of all the 4 of us. I can get a POA from my sons to execute the necessary documents,but my query is:
Will this power of attorney be a simple one for purposes of executing the documents and receiving the title deeds from the Bank OR construed as dealing with landed property hence requiring a GPA for which ad valorem stamp duty has to be paid and needs to be registerd?My take is that since there is no transfer of ownership by my sons the POA should not attract advalorem stamp duty etc.I need experts guidance.

Double employment

One of my friend is trouble in double employment where he is working in company x and he resigned from that company on date 06 apr 2017 with 3 month notice period.he have one offer from company y but issue is he has to join company y in 2 and half month.but company x is not ready to give release before 15 days.


1.can he work next 15 days in both company?
2.if company y HR is ok with this.then any issue will come in future in his career?


Please suggest on above issue.

D/sir, kindly help tenents not vacating my widow mother shop 73 years old .tenents signed written stamp paper whenever you required the shop TENENTS WILL VACATE. BUT NOW HE DIDI NOT VACATING SHOP -AND HE FILED CASE AND TAKE stay order . kindly help how to get vacate shop

C/s documents access

SIRS
You had advised me to change the lawyer falsely fabricating documents and scaring me that I have breached injunction and plaintiffs have filed contempt application and that I will be imprisoned etc etc since 2015 Dec.
As I guessed it was all fabricated I did not go to meet him personally. Court where suit is filed is very far.
I also conveyed my views to lawyer who stopped threatening me and now only sends status information ( software).
Lawyer has managed to be lawyer of one of the Plaintiffs and also other late defendant my late POA. lawyer was hired by my co-defendant and I am not known to him. I also paid handsome fee instalment. That is why I am scared of changing lawyer and I have little at stake except breach of injuction if any.
On June 9 th I went to court and asked for my C/s proceedings papers but clerk refused saying that come on the date. As per online C/s status plaintiffs evidence with remarks A, next date since last one year
Please give your views and how can I access court proceedings papers for perusal. Regret for being verbose. Regards.

Regarding dvc case

Dear sirs

I would like to thank you all for your guidance in defending my 498a case.

Now myself and my parents have been aquented.

In case of dvc which was filed by my wife was stayed by honarable high court as I have gone against the interim order of maintenance and exparte order.

Honarable high court in May 2017 gave judgement in my favor by giving order to grant maintenance to my daughter of rs 5000 only and setting aside exparte order.

Please note that my wife is a central govt employee and earning a salary more than 70k per month.

My queries are:

1. Do dvc court take cognizance of my aquinttel in 498a , as all allegations made by her are same.

2. 498a judgement clearly states that it is a false case and they have utterly failed to prove offenses.

3. I am basically an NRI , while deciding the alimony do lower court take cognizance of her employment details , which she her self has accepted of her employment details in court.

4. Will she be eligible for any maintenance, I am ready to take the responsibilitiy of maintaining my child.
