Dear sir, i am army officer and own ancestral agricultural land in dist hapur, up. my father expired in year 2011 and property was transferred equally in mother and my name. my mother expired in jun 17. post her thervi ritual a party approached me and informed me that my mother had made an agreement with them to sell her share of land for 20 lac out of which 16 lac they had paid as advance to her. they told me that either return the amount with interest transfer the land to them .
i asked them to give me copy of agreement. it was a registered agreement which said that 16 lac was paid in advance . of this 16 lac ,3 lac was paid by cheque( which was not ac payee) and 13 lac was in cash.
i feel a foul play in this agreement, as i being a legal heir was not informed of this deal. secondly there was no requirement of selling land or money as im earning well and my mother was getting pension of 25k pm. no transection of such large amount has taken place in my mothers account . even the witness in this agreement are not my relatives.
during discussion party told that if i do not refund money or transfer land they will approach court and then i will not have any chance but to hand over the property to them at the cost that is written on paper which is obviously very less as compared to market cost.
i presently on my duty and through my acquaintances in village it was informed that the party has approached court for this case.
kindly guide me on future of this case. am i bound to sell this my land if he goes to court. if he proves in court that the deal is correct, will the court give me chance to return amount if i dont wish to sell the land.
Sir,
What is the difference between WA and WASR?? For some cases having WASR Number (Eg WASR 145481/2017) appeared in court website does not show the details of Petitioner and Respondent. So, I want to know exactly what this WASR is about?? Thanks & Regards...
