Society not adopted and accepted previos a/c and minutes

Respected Sirs,

I am living in Co-HSg society of 168 members form in 2013. Administrator rules the society from may 16 to Aug,17. Election held in Aug,17 and new MC comes in rule. Yesterday our society held 4th AGM for which agenda is circulated. Managing committee starts the meeting as per Agenda and during the points of adoption of Accounts (Which is not audited and administrator Signed on it) inform to the members, accounts are stillnot audited from FY 13-14 to FY 16-17, so no such adoption we are doing. During point to acceptance of the 3 AGM, MC committee informed members due to some mistakes in the minutes we are not going to accept the same, so no such minutes of 3rs AGM not accepted but other point get discussed.

Now my question is,

Can MC starts other points of Agend if the adoption of accounts and acceptance of previous AGM minutes not done?
Is Accounts is adopted in SGM as AGM is over or we need to wait for next AGM?
Is the AGM is fitted in the rules?

Kindly revert with your valuable reply on the same.

Regards,

Ajay Kochar

Credit card due

Dear experts:
My father passed away in the month of May 2017. He is 67. He holds credit card from private bank. We have visited the branch along with death certificate for the purpose of closing his bank account as well as credig card.

But, bank employees not accepted our request due to credit card due. They told, my fater took personal loan againt credit card and it should repaid before closing the credit card account as well as bank account.

Therefore, I was receiving many calls from credit card recovery agents. Each time I told that, I'm not proper person to whom you are calling. The account holder deceased and we have death certificate. In July 2017, some one called from chennai and told that, If I repaid 16K then card will be close and I will received closure letter after 15 days. I paid by cheque, but nothing I received.

Again, in Aug 2017, someone recover agent called and ask for Rs. 1,500/- He told that, the previous person made wrong calculation. Therefore, the credit card not yet closed. If I paid Rs. 1,500/- by cash then it will close and I will receive closure letter within week. I paid but nothing I received.

Now, someone calling and demanding Rs. 1.0 lac. I asked for account closure letter. But, he given 'credit card settlement latter' and it says that, my father has requested for settlement due to his financial conditions. Therefore, bank has given 3 instalment.

I told that, my father was died and how he requested for credit card due settlement. But, they were not giving proper answer and demanding Rs. 35.0K immediately. Further, I asked that, how a senior citizen can get 3.27 lac as personal loan without any proper income proof. But no proper from them.

Now, please advice what I can do?

Right place to apply for legal heir

Dear Sir,
To apply for legal heir I went to a lawyer in Rohini court in Delhi. He advised me to apply in this court and said he will charge 15000/-.
My questions are
1. Is he charging more or it is appropriate.
2. I read that legal heir can be done either in Tehsil office or area sub divisional magistrate office.
Please guide me.

What all can i take up after enrollment in state bar council

Hello,
I have recently got enrolled in the bar council of Karnataka. According to my knowledge, now I can practice law in the court. But I am not clear about what are the DOs and DONTs even after getting enrolled in a state bar council. I would like to know whether I still remain as a dependent until I pass All India Bar Examination which allows for more power.
Thanks in Advance.

can my neighbour get stay order court stay order

Hi
i have bought an old house recently of 250 sqr yrds. I want to demolish the old house and construct a new house its place.
Before buying the plot i checked all link documents and the plot was indeed registered in the name of the person from whom i bought it. I have done registration of this plot in my name after buying it and also acquired a building permission from local munical body. I am also in the possession of the property and mutated the properrty in my name in local municipal council, electricity and water.
Now one person approached me and said that the plot is under litigation and there is a court case pending and that he will not allow me to do any construction on yhis site and that they are the actual owners of the land.
i then confronted the person who sold this plot to me for hiding this peice of information from me before buying the plot and he told me that the case is indeed pending in court but he is the actual owner and that the case will go in our favour anyway.
he gave me the case papers and explained to me about the case as below

The first owner who had 1 acre land and he sub divided it into plots and sold it under registered sale deeds to different people. i bought it from the person who in turn bought it from the first owner in 1995.

The person who has approched me and said he will stop the construction is the petitioner in the ccase and the first owner of the plot who divided 1 acre into sub plots is the defendant in the case.

the defendant who is my first owner won the case in the city civil court in 2010 and the court gave the judement in his favour confirming the title on the land and his own.

The petitioner has now appealed in the same court against the judgement and it is pending in the court since 2010 to till date.

The person from whom I bought the land is saying that the petitioner does not have any right on thr property and he already.lost the case in court as he could not prove his ownership over the land. he is filing cases just to take advantage of the pendancy of case in the court to harass people who are original owners and he said that the appeal will also go in oir favour.

in this scenario

1) can the petitioner stop my construction? can he get stay order from court? i have thr building permission and also registered sale deed with me.

2) can he complain to police showing the pending case appeal papers and do the police have authority to stop my construction? provided he actually lost the case in court and now appealing against that decision.
3) will the local.munipality stop my construction if he complains to them? i have already obtained the building permission.
4) what steps can i take so that he does not cause me any issues during construction?

Please help. Your advice will be greatly appreciated.
