Dear Sir,
Please let me know the decision based on the following scenerio
1) There are 1 Bhk and 2 Bhk flat with 20 nos each in our society. Total 40 Nos in a society.
2) 1Bhk having 1 No. washroom and 2 Bhk having 2 No. washroom and both having 1 kitchen
3) Bye Law says : Water Charges - On the basis of total number and size of inlets provided in each flat.
4) Corporation water which is chargable by corporation is lifted in overhead tank and distributed equally between 1 Bhk and 2 Bhk flat as both having one inlet in Kitchen.
5) Borewell water is free of cost to society which is also lifted in overhead tank and distributed. But 1 bhk has one inlet and 2bhk has 2 inlet due to difference in washroom nos.
6) Borewell water is also used for car washing and some memebers do not have vehicle at home.
7) Borewell water is also used for Gardening purpose
8) Borewell water is also used at common washroom at society parking used by all i.e security person, person to comes for any work in society....etc
9) There is only one electric meter for all these water motor/pumps. From above points it is seen that water is used at many places leaving that used by flats.
10) Please let me know motor electric charges for uplifting water are part of this bye laws saying "On the basis of total number and size of inlets provided in each flat." Byelaws mentions common electric charges to be shared equally. But since water charges are on inlets so does electric charges will also be charged accordingly???
11) Water meter is not fitted in any of the flats, but if fitted then also taking monthly reading of so many flats and dividing amongst all will be impossible.
Seeing all above points please let me know how to calculate water charges for each flat based on so many parameters.

How to recover the amount paid interim order of 125 cr.p.c. and D.V.C. case after winning the main case.
Please mention if any such section available in C.P.C. , Cr.P.C or I.P.C.

residential apartment which has 5 houses with different owners each and 3 have family resident . Can the remaining two owners can rent the apartment to a middle man for service apartments . Which has people from all over the world come and stay for short duration. Will this come under commercialisation and Can this happen if any of the other residents oppose

Dear Experts,
Recently, I bought 2200 SQ FT land property (DTCP approved in 1992) that was previously disputed by neighbor and resolved in local civil court.
The property went through the following facts:
1) In 2008, Neighbor broke boundary wall built by pervious owner, filed a petition in court that he owns some (560 SQ FT) of the property, as per his registration document, he bought his property in 2002 with attached hand written site layout plan (which are incorrect as per actual Municipality layout plan).
2) March 2017, Court verified municipality layout plan, surveyor report, disposed case as "Uncontested and DISMISSED WITH COSTS".
He came to know that new owners brought the property, he intruded, broke our new boundary wall overnight without court order and plotted layout marking stones as per his document. I certainly do have proper valid registration documents, DTCP approved layout plan and GOVT surveyor report.
Please advice,
1) If i can file criminal case legally as he violated judgement made by local civil court?
2) How can i quickly resolve this dispute? Remedies?

Dear Sir,
I took an Education loan of 3.8 lac from OBC bank for B.tech in 2010 & in 2014 I got placed in an MNC & start to pay my EMI but after Nov 2016 I had to leave my job due to health issues.Now, bank has sent me a notice that My Education Loan account From OBC bank has become NPA.They have advised in notice to pay the Prime amount either in two installments or pay interest of approx 1.8 lac & then continue EMI.I am preparing for Govt. Exams(GATE 2018) & also cleared 3 exams(Coal India MT ,JWM ordinance factory & Vizag steel MT) in written & hope so that I can take a Govt. Job in 2018 definately.
What should I do or commit to bank to handle this situation?
Note- I am focusing on my preparation for GATE 2018 as exam will be held on 3 Feb.

Dear sir, how will of person can be executed incase of death of beneficiaries of will?. And is it possible to execute a will only for Bank balance or it should be contain all the property of Testetor.?

Hi ,
My name is vikas and am based out of hyderabad, i wanted to know few things regarding partition suit.
we have an asset owned which is in dispute the lower court(city civil court) has passed an preliminary decree stating that "the scheduled property can be divided into two equal shares and seperate petitions can be filled for mesne profits if any.
we have filed a petition in high court for issuing the stay("there shall be an interim stay on passing the final decree adn all other proceedings shall go on ,if any") against the lower court order.
Next the plaintiff have filed IA for appointing advocate commission , thereafter we have raised a question in court against the IA stating "since there is a stay for final decree the advocate commission cannot be appointed untill the stay is lifted".
Now the high court has passed an order as below
"while upholding the order of trial Court, only to clear
the mist as apprehended by the petitioners, I deem it appropriate
to clarify that the Order of the trial Court, against which this
petition is filed, is only to the extent of the advocate commissioner
undertaking exercise to divide the suit schedule property into two
shares in terms of the preliminary decree and to submit a report to
the trial Court and that he is not authorized to divide the suit
schedule property physically."
Is there any chance for stopping the advocate commissioner not to be appointed and also would like to know on good adovcate in hyderabad to contact .
