Ordinary Residence

My father was born in Bihar. He doesn't have any house in delhi. But he has been living in delhi from past some years.
He has voter id card which was made by Rent agreement.

So in which state, He will consider as a Ordinary residence ????
He is a Ordinary residence of bihar or Delhi??

Access to terrace(common area) denied by housing society

Ours is a residential housing society in Mumbai. Our Housing Society and Administrator(appointed by Registrar) is denying us access to the 7th and 8th floor terraces. They have locked it and wont allow us access for any reason whatsoever.

The terrace on the 7th floor is a pocket terrace and is adjacent to my 2 flats. The terrace is part of common area and therefore no Managing Committee, General Body or Government Officer can deny access to any member to the common areas of the building as this is our basic right.

Kindly let me know what action I can take under which law (please give me exact referrals and where I can source it) if I have to go to court that could help in winning my case. The local bodies (Fire Brigade, BMC) have been bribed and are not willing to take action against the Society. We have exhausted all options and would appreciate your guidance.

I had researched online that MOFA, DCR rules & Maharashtra Fire Prevention Life Safety Act support my case but I cant find the specific clauses. Can you please guide me?

Cash transaction for property

I would like to know if buying a property with 1/2 cash & 1/2 direct transfer is illegal? my total funds are fully tax paid and i can show sources of my funds. Is buyer at fault in such case either from IT dept or from sub registrar who registered the property?
I cant speak for seller. I am not sure if he accounted the cash. transaction was made prior to demonetization. I read rules that after demon, cash withdrawals above certain limit are not allowed.

Joining in post with same grade pay

Sir, i was working as an assistant teacher in primary school of department of Elementary Education and at the time of working a new vacancy of teacher came out and i applied to the post of assistant teacher in primary school in that advertisement in the same grade pay without the knowledge of the department, it is to be noted that the advertisement contained a point where it was mentioned that the teacher working in lower primary school cannot apply again in lower primary school as a teacher, but i applied in the advertisement and when got selected resigned from my present post and joined in the new post without the knowledge of the department and without any pay protection, know i want to know that if the department come to know about this can they take any action against me and was the point that contained in the advertisement valid that the teacher working in primary school cannot apply again in the primary school as a teacher in the same grade pay. I want to know whether they is any judgement of court in this type of matter, whether court will give decision in my favour , i want toknow that am i in default by joining in the post with same grade pay, is it wrong to join in same grade pay, in my case i have resigned from the previous post without taking the past service benefits, is there any rules that a person cannot join in the same grade pay, is the same problem faced by anyone before, has the court given any judgement in this type of case, kindly give the answers with proper references if any

Changing my name in academic certificates

I am living in Hyderabad,I am a Muslim,my name Salman, now I want to convert into Hindu.I studied post graduation,after conversion my name also changed as Hindu, can I change my name in SSC(10th class)Salman to new name, in my academic certificates my name is Salman.also in intermediate,graduation,post graduation.can it be changed with my new name or it remains the same old name?or I have to mention my name as salman"alias" new name?

Query on RCR transfered u/s24

Dear Experts,
I have lodged RCR on Feb 2017 on 1st date wife has attened with her advocate but till oct 2017 she has not submit her statement nor attend in court. After oct 2017 case gone for ex-part hearing and chief details already been submitted in court from my side. Now she filed a case u/s 24 for transfer her juridicsion where she has currently living.
I want to know if she got order from HC case would be transfered but is this case will start from begaing or from current senario.
If a case stands on ex-part and alredy crossed the time limit she can submit her statement and court will accept it???

Addition of co-owner r

Hi,
My father is having a residence property where he is the 1st owner and my mother is the second owner. Both are having 50% shares. My father has 2 daughters and myself as a son. My 1 sister is younger and 1 is elder which is married. My mom passed and elder sister passed away in 2012 and 2013 resp. Now my dad wants to add me as a 50% holder in place of my Mom. Can you tell me what�s the procedure we need to follow.
I googled and got to know that we need to make release deed of my mother and again have to do Registration in presence of my younger sister and brother in law (because my elder sister passed away) and they have to sign on NOc that they are not interested in the property and adding my name as 50% owner.
Can you please suggest what�s the exact procedure

Dv/crpc 125/rcr

My wife registered DV against me and my parents which is in "Issue of notice" stage .Mean while she filed Crpc 125,for which I submitted a objection statement with her qualification and work experiences. While submitting objection for Crpc125, judge informed us that she also filed section 9 of RCR which is also in "Issue of notice”. For Crpc 125 case referred us to counseling. Counseling was successful, she agreed in front of counselor to re-union back to matrimonial home without any condition. Counselor submitted report to court stating“Counseling between the parties was successful and disputes were settled”. On counseling day her advocate told they will withdraw the DV and through joint memo these cases can be settled. She suppose to be appear to court last week, but she was absent & now through her advocate putting new condition that DV case she won’t withdraw till my parents leave separately. She wants to put both Crpc 125& RCR case on observation. I need advice from experts on my further action. For her RCR,till now i not submitted any replay,(i,e objection or no-objection), for her Crpc 125 objection is submitted .I am not at all ready to accept her condition of keeping my parents separate. She is not allowing me to see my 4 year daughter & recently stating her health condition she also left the job.
