Sir,
Would like to know the status of property whether belongs to inherited, facts as below;
We are three children to our parents. A self acquired property belongs to grant father got executed and registered on my mother name in 1980, later the same transferred to my brother in 1996 and registered before local SRO without consent of two other brothers. I am the elder and in possession of that property and made substantial structural changes with permission from local authority.
Hence would like to know whether the property comes under category of inheritance property or not. If so please suggest due remedies.
Thanks
Roshan

I have few clarifications on the AGPA and requests if experts could respond. There may have been previous queries on the subject but appreciate to have fresh responses based on the recent verdicts if any. Thanks.
Can a residential property be purchased from a person holding the AGPA? Can the AGPA is authorized to sell that property? To whom shall the payment be made? To AGPA or to the owner of the property? Will the owner’s signatures be required in the Sale Deed documents or anywhere? Will the owner’s presence is necessary at the registration office?

Hi,
For a vacant approved plot purchased in Chennai, the approach road to reach the plot is, to pass through 30feet road, 24feet road and then through 20feet. All these roads/passages are appearing in the approved layout. When construction plan was applied to CMDA, the officials stated that 20feet road is considered as a passage, but 24feet road has to be handed over through gift deed to corporation by the land owner. This was not done by land owner at the time when this land was divided into plots and approved. Now the land owner is hesitant to reach out to concerned officials (plot approval was done by councillor) to perform this gift deed process. As CMDA not approving on construction plan, is there a way out to move forward to overcome this issue.

Dear All
In 2016 in the case matter of Indrani Wahi ( Appellant ) Vs Registrar of Coop. Societies & ORS (Respondents ) with Civil Appeal No. 4930 of 2006 ( Page 20 of the judgement) the decision has come as under :
" Nominee of Deceased Member is absolutely entitled for the Ownership by transfer, Co-op. Soc. can't challenge the right of Nominee a settled Law of the land. No legal heirship, court order or succession certificate is required.
The Cooperative Society has no option whatsoever, except to transfer the membership in the name of the nominee, in consonance with Sections 79 and 80 of the 1983 Act (read with Rules 127 and 128 of the 1987 Rules). That, would have no relevance to the issue of title between the inheritors or successors to the property of the deceased.
It shall however, be open to the other members of the family, to pursue his case of succession or inheritance, in consonance with law.
Here my query is whether the above Supreme Court Verdict will also be applicable in the case of MCS Act(Maharashtra Cooperative Soc. Act) as in the above case the judgement has been made against West Bengal Coop Soc. Act Act
Please revert on the same at the earliest.
Thanks & Regards

Hello experts,
I am working in govt. My family choose a girl for me. I also accepted that girl. after one month of conversation we got engagged. but after engagement i found she had past i came to know this and when i asked about this she accept it but she never told me clearly about that relationship i was asking how much that relationship was (means is there any physical ) but she never told, the another problem is her family background is not good. They are weak in wealth but never showed this. Their family is very arrogant in nature. specially her mother and maternal uncle doesnt know how to behave with son in law. whenever argue is with us her mother joined in that and it increases, even her other family members are also very poor in behaviour. I have also dought that in future wheather she will take care of my parents or not. But i want to marry her because i love her. I dont know whether she loves me or not or still she has her past in her mind. Now how will i go from here wether i should marry her or i should left. But leaving her is also very difficult for me because i love her sooo much. What should i do. how will i accept her past its going to very difficult for me.
