Regarding section 25 and detailed answer

I had married a girl under special marriage act 1954 on October 2013.But after the marriage the girl told that she will convince her parents and come back to my house and the marriage will b held socially.any way she was connected to me comming to my house and relationship continued till June 2017.But we did'nt stayed together since the initiall days.suddenly she came and asked me for divorce.Now last month she has filled for the marriage to b null and void under section 25 of Special marriage act.The grounds she has filled in the petition is totally false.She has written that me and my mother mix something in cold drinks and take her sign cunningly.She was not in love with me and treated me as friend.She also mentioned that she was not knowing about the marriage occured earlier and only came to know when i showed her the certificate on last 27th June 2017.This is completely false allegations.The circumstances are different.She also mentioned that she was unaware of my qualification.so this marriage should be null and void.I want to knw the authentication of this petition and shall the court pass null and void order after 4 years of marriage registration?She also mentioned there we did'nt live together and have no physical relationship.I had filled a Restitution to conjugal rights petition too.

Hibanama as per muslim law

Dear Learned Sirs,

I have a query. Kindly advise me. For my ancestral property of Dada, which was divided between 2 brothers and 1 sister as per Shariah (40, 40, 20 ratio). One is my father, other is my Chacha and 3rd is my Phuppo.
Around 25 or more years back, it was decided that the plot belonging to all three will be given to my father name as Hiba. My chacha and my phuppo gave possession of the land to my father and left their rights orally in witness of my Chachi, My phuppa and few other relatives.

The land is in our possession since then and nobody has any claim on it from any side. Now I want it to put on paper. I want a HIbanama from both parties (my chacha is no more now and only my phuppo is left). Kindly advice how to proceed and get it on papers. I have read my articles and judgements where it is confirmed that Hiba can be done orally and no document is needed if three conditions are fulfilled and if any written deed is there it will serve as the document of evidence. Also the gift deed Hibanama need not be registered through Registrar under Registration Act.

Kindly advice how to proceed further and get it on papers either through Court or any other way as my father cannot afford to pay for registry fees as he is a small time pensioner.

Thanks in advance.

Regards

Ipc 306- please assist

Dear Sir/Madam,

A1-> sister, A2-> brother-in-law, B1-> Lady, B2 -> B1's husband

Case Filed by Police: B2 filed a case stating that, B1 mistakenly sent a message to A2 phone. A1 saw this message and called B1 and B2 to their house. Both A1,A2 abused B1,B2. They go on stating that, B1 said sorry to A1 as the message was mistakenly sent but still A1 and A2 both started spreading rumors about her character in the community, which caused B1 to commit suicide.

Background: B1's dad is a serving police officer and was informed by our lawyer that there are no hard evidences but still because of this influence they(A1,A2) were sent to jail. Our lawyer is saying that police will buy time to file charge sheet as they do not have strong evidence. I feel they just want to take revenge by making them stay in jail for 90 days.

Current Situation: After 15 days of B1's death, both A1 and A2 are arrested on IPC 306 and sent to jail . Its been a week they both are in Jail. Yesterday the sessions court has rejected their bail plea. Our lawyer is suggesting that, we should go to high court for bail. I am very confused. Should we approach high court for bail or should i consult some other lawyer. Any advise is appreciated.

Question1- Will they get bail in high court?
Question2- Can police take really 90 days to file charge sheet?
Question3- What options do we have to get them out?
