Good Morning Sir/Madam,

I have just have one question.

Hum teen bhai hain. Teeno ek hi ghar main rehte hain. Ground Floor, First foolr and 2nd floor. 2016 main mere father expire ho gaye aur 2017 main my mom. Mere father ne will hum teeno bhai ko ek floor de diya.

Mera question ye hai ki law k hisab se ghar ki chat par kiska right hoga. hum teeno bhai ka ya jo 2nd floor par rehta hai oska.

Pls advice?

Will

A person has two sons,can he make separate will for both of them, is it valid ? Or he has to cancel both and he should make one single will for both sons.?

Review

In a motor accident claim matter, the R1 registered owner was already transferred the vehicle before accident to some one. from subsequent owner R2 purchased it and while driven by him it met the accident. But the ownership was not changed to R2.Though notice of the matter was received to the R1, he did not appeared through counsel but informed the person who purchased the vehicle from him to settle the dispute. Instead of settling the issue he managed to file forged vakalath and written statement for the R1 . As R2 had no license to drive, the award is passed against the registered owner R1 and R2 driver. Now the R1 filed Review petition before the MACT court to review the award on following grounds.(1) The award is erroneous as it based on fake written statement and other documents. As R1 did not filed vakalath or written statement the award considering it's as R1's is not proper. it is apparent error on the face of the record. Is review can be allowed. Is any ruling fit to this situation. In the case of transferred vehicle registered owner is liable ?

Want to transfer pagadi system house rent receipt in my name

Hello Sir,

In 2014 I had purchased a Pagadi system house in mumbai, but I was not aware of the pagadi system or rent act then hence I ended up buying this house from the third tenant who had not transferred the Rent receipt in his name. also the second tenant from whom this third tenant had purchased this house had not transferred the Rent receipt in his name.
also the whole plot/Land (where my house is also situated) was entitled to three brothers (as per property card) and all of them are dead, and their legal heirs are now their sons with some partial plot entitlements.

Now after knowing the rent act, I followed up with these Legal heirs continuously for transferring the rent receipt in my name and fortunately two of them have agreed for. These two heirs are sons of Elder brother of original three brothers/landlords and each of these two have the 1/4th entitlement of 1/3rd of their father share.

Hence I want to know that if these two with 1/4th entitlement of 1/3rd of their father share have the right to transfer the rent receipt in my name.

Please guide me and give me your best opinion.

Writ petition

Hi Respected Members, One of my client has been sent to jail in maintenance proceeding as due to paucity of fund he was not making payment towards maintenance in ex-parte under 125 crpc. Also, the Judge didn't follow the 125(3) provision and also refused to accept 127 application which we filed on ground that because in jail, hence no income in that period with Bombay HC judgement which he refused in a arbitrary manner. I have filed a writ petition in Delhi HC which is under objection that proper parties are not made. I chose only husband and wife as a party as this was my first writ petition in HC. If any respected member can please tell me what other parties should be included in this writ petition. I am asking for Habeas corpus and writ of certiorari.

What after section 9 of hindu marriage act ?

Me & my wife got married on 24th Jan 2017. After some complications, we are living separately from 13th May 2017. I filed RCR under section 9 of HMA but didnt attend any dates of court. She moved application for interim maintenance on 16/08/2017 & got maintenance as 6k per month. When she was living with me from 24th Jan 2017 to 13th May 2017, she started abusive words to me & my parents. She even tried to suicide by knife & tried to hit me by knife. She started screaming at my home without any valid reason just like I am beating her. What is procedure to file divorce in this condition ?

Gift deed and nri

Hello,
Am Lakshmi and we are residing in New york(NRI) with my husband and child.
My husband(Bala) is to get a house as gift from his brothers.

The house is two portions(front and back) house which is located in Mahabubnagar, Telangana, India.The first elder brother constructed his house in from part facing the road. and the second eldest brother constructed the house in the back of the first house. Both commonly sharing a portion in between their houses as it contains staircases for upper floors.

In the existing document of houses which is registered on both of their names doesn't mention any common area.

Now the second brother is gifting his portion of the property to my husband. but the newly prepared gift deed document copy we received for reviewing includes a common area with staircases and also a common area for entrance to walk to the backside house which we will receive as a gift.

As we are not unable to personally attend for registration, the gift deed prepared has provision for the signature of his elder brothers(donors) only. The document writer mentioned us that my husband signature is not required.

They also sent a General Power of Attorney to appoint my father-in-law as my husband agent to sign any documents if needed.

Please suggest me is GPA really needed for completion of registration. The writer mentioned that special power of attorney is not valid to present. But we are not willing to give GPA.

Please suggest what are our ways to get the property in my husband name without us traveling to India for registration.

Can i file complaint case for giving wrong information

Dear Experts,
My query is that can i file complaint case for giving wrong information in LIC , Bank accounts, Electoral roll.
Fact is that my father got married with other lady during lifetime of my mother. He did not disclose the fact during my mother lifetime. my mother was passed away in 2009. when i came to knew that i have filled the case against my father for marry again during my mother life time. My father stated in his reply that he got married with the lady in 2015.I do not have any ceremonial evidence of my father's 2nd marriage.i have the information of voter id , Bank Accounts, Lic of that lady in which she used my father's name as a Husband during my moher life time. Similarly that lady was nominee as a wife in my father's Bank Accounts , Lic etc .She was also enrolled as a wife in my Father's ration Card before 2009. Can i give information to all concerned department to file complaint case against my father and his 2nd wife for giving wrong information.
