Error in plot Registration

hi. i recently bought a land 2 plots of each 2.75 cents. at the time of registration because of no care of address in adhar card land owner registered the propery with representative and entered my adhar card details. but the name in adhar card was not updated during the process. after the process i updated the adhar card as "mansoor basha" where in the registration it has "mansur basha". my adhar number is there on the registration document even the name is wrongly spelt. so my question is will it make any legal problems in future. or it should be ok to leave the name as it is in the document as "mansur basha"

General affidavit (stamp paper) weightage is more then written statement of court

Or

Written statements of court weightage is more then general affidavit ( stamp paper).

Defame case

Ronika and manish married on 10-10-15, husband & wife running their case in family court . In beginning Manish filled petition for divorce from Ronika... Even Ronika gave replied to Manish's notice and submitted W.S on 10-3-17 in family court.. After wards Ronika declared under oath on affidavit regarding marital status as UNMARRIED in election ...on 20-10-16. In addition Ronika declare that she is wife of her father in general affidavit which was additional attachment to other election affidavits . Manish received her election affidavit of unmarried status via RTI and submitted to family court judge .. Manish filled private case under section IPC 420 & 406 in criminal court on 12-8-17. Even criminal court judge issued notice to Ronika under IPC 420 & 406.Even election commission launched 125A RP act 1951 against Ronika .

My question
Possible for Manish to launch defamation case against Ronika ?

How much money do Manish need to pay to court ?

Refund of deposit

Hello Sir/Madam,
My father registered for a private builder property and deposited some money.
The project didn't take off.
The money wil be refunded to all the investors now.

My father passed away some years back.
How should the builder refund the money? By cheque in the name of my father? or We have to produce some document to get the cheque in the name of another family member? If a document is needed, what is that document called?

Thanks in advance to anyone who gives clarity on this.

Cooperative society act

Hi

We are a small coooperative housing society in Rajkot

14 Members in all

Unfortunately there has been no regulatory body to the society and there have been no regular meetings nor any records have been maintained

But mutually it was agreed that the property in the society will not be sold for commercial purposes

Ours is not a closed door society and there has been lot of commercialization in the adjacent localities

so some members requested for permission to sell it of to builders as there are no individuals who would buy a property in the commercial zone now

My concerns :

Can the society by majority pass a resolution that the permission be given to members to sell of the property to builders? If Yes what is the quorum for majority?

If any member objects to the same on an individual level or may be 3 or 4 members do not want to leave the area as they cannot afford bunglows in better areas, what would be the consequences?

Can we go for a restructuring the society and isolate the members not keen on joining us ?

Can we dissolve the society ?

What are other options available which are easy and can prevent any legal issues?

Property schedule boundaries


Dear Experts,

I have bought a 2 acre farm land sold by a farmer family (gift deed from Husband to wife out of 5 acres), with schedule of property including roads on two sides and the vendors land on the other two sides, 2+ years ago. On one of the sides is a gravational canal (Nala, that existed for decades) adjoining my land next to road running all along for 250+meters. We have built a fence with vendors agreement (that I will not get the Nala part), villagers witness, ~2.5 years ago excluding this canal. I have also gotten a Survey partitioned assigned for the land. Now this farmer started dispute that I need to also take the canal as part of my land which is about 0.5 acre (between road and fence all along), as my property schedule boundaries indicate between the two roads. We have done the Survey (with Tehasil office surveyor) Sept2017 and the land within the fence in possession belongs to me (Panchanama signed by farmer (husband) with initials though, in presence of several villagers witness). However the farmer still insist that I move into the canal (Nala) because the boundaries indicated road on both sides in the registration document. He has removed the fence late Dec2017 which covers about 0.5 acre part saying that I have excess land and that I need to move into Nala.

I have started Guava plantation in the 2 acres, with drip facility 2.5 year's ago;
An entry gate, an RCC Water storage construction and a cement pipes culvert to cross the Nala into gate has been done 2.5 year's ago which comes under the disputed portion.

I have tried to settle with other villagers headmen but this farmer will not listen.

I have arranged to send a court notice order 2 months ago and this farmer has also filled a counter petition (with the claim that including Nala he has 2.5 acres land, the Nala come under his overall 5 acres). He is resisting any farming activity in the disputed area for the last 4-5 months; he has removed the drip pipes in the disputed area and hidden them.

What options do I have now:

(1) is there a chance to get the Injunction order to continue with Guava farming with the counter petition, if so how much time does it take.

Deportation

Hello, I do not know which category my question would fit in. However my husband was deported from Denmark in June 2015 and had a 2 year ban on the passport.
We as family , so my husband my 4 month old son and me had gone to Denmark for a vacation and meet few friends there. My husband is a tattoo artist, been an artist he is well know individual in his industry all over the globe for the art that he performs. While our stay there we were helped by few of his friends as we had a child with us, as a gesture he tattooed few of them with no monetary return. He was Not asked nor was he allowed to give any explanation. We had a language barrier as we did not know danish. They may be got us signed a form which we assumed mentioned taht my husband did it on purpose. However it was lack of knowledge and ignorance that he tattooed his friend. Now it�s been 4 years and his Visa for Germany was rejected even New Zealand. We are not able to understand what should we do as we are really keen on traveling the world. We accept that ignorance and lack of knowledge on our part has caused us to reach this situation and we might be guilty for that country, however I really want things to be right and I am able to go out with my husband. Honestly we are well settled in our county and have a huge business here so we planning to shift anywhere abroad has never been our thing.

We need guidance as to whom should we talk to, or what would be the right path, to explain them this and clear our doubts and their and get Visa for traveling.

What's the Best way to transfer Property rights ?

My father and my uncle are the sole owners of our ancestral property in Delhi.

My uncle lives separately and now bed-ridden due to old age.

Now we want to sell our property, so what's the right legal way as he can't go to registrar office to sign the deal ?

a) Should he make a Gift deed and transfer his rights ? (We fear his children may challenge it later)

b) we give him his share of money and he make a power of attorney in favour of my father ?

c) Straight sale deed to buyer ?
