Criminal and civil defamation cases

Issues existed on admin of Apartments Association. High level enemity between 2 persons. The defacto complainant lodged a false complaint on the other person and myself. A FIR was registered on Dec/2018 under ipc 294(b),323 and 506(1). I was arrayed as A2. But Police dropped me in the Chargesheet filed in 2023. Case was under process in judicial court . During the enquiry level the A1 died in Jan 2024.The defacto Complainant had filed a protest petition but did not appear for a hearing and finally it was not pressed by the defacto complainant, The court disposed both the case on A1 and protest petition of the defacto complainat (as he did not press) in March 2024.
Now may I file both criminal and civil suit for defamation?
If so, may I have to serve legal notice first and then in court?. May I file defamation cases in High Court directly? please guide me

Missing gpa docs for seller

I have shortlisted a resale home (Land+very old house) to buy in Bangalore. But current seller doesn't have GPA documents. It is very old property and current seller is in procession of this property from last 40 years.

Sale deed was done by previous seller's GPA to my current seller, but current seller doesn't have any records or document for GPA. Since sale deed registration happened 40 years before, GPA likely to be unregistered one.
When I applied for bank loan, banker lawyer is not approving without GPA documents. Please advise, if there is any remedy for it?
Will it be wise to go ahead with this deal even some private banks offer loan to me?

Illegal possession of common area of

A standalone 3 storeyed building with 2 flats on each floor. There is a big motor pump room as common facility area, all owners have the key. The motor pump room has been recently illegally taken over by one of the flat owner and he is using it as his personal servant quarter. He has changed the locks. What legal recourse do we have as flat owners, with right over common area facility?

Spelling mistake in name in e challan

Hi I just did a sale deed for a flat and all the details in Agreement are correct and with spelling and particulars. But the e challan created for stamp duty and registration has one letter of my first name changed will it cause any issue. Shoud i do something about it. I have to move ahead with submitting the agreement for Loan in bank and further procedures pls let me know if need any action from my side.

Gift deed by spa holder

Hi

My father had bought a DDA apartment from an original allottee vide SPA in 1994. He now wants to register the same in my name by executing and registering a gift deed. Is this feasible and would this transaction be valid?

Departmental enquiry

Audio recordings was made on the compact disc and this was mentioned as one of the management exhibits by the presenting officer and it was accepted by the enquiry officer. In the begining of the enquiry, when CSE questioned the PO to produce the CD, the Presenting Officer said in many times, he will NOT produce any CD of recordings. BUT later he produced the CD after the exit of 1st witness MW1. The MW2 and MW5 only endorsed the CD. MW3 and MW4 the CD was not produced. Though the CD did not contain the charge sheet abusals, but only the voice which was supported by MW2 and MW5 .The CSE defence DW1 said , the voice was not of CSE in the CD. THE EO was in full favour of management. Though I mentioned in writing about PO statements on not producing the CD and this CD was not underwent any tests
