Dear friends,

Is Power Of Attorney Registration is mandatory? In the contest of,

1)The SC judgment AIR 1979 SC 533 Of "Sayed Abdul Kader Vs Rami reddy", Judgment dated:29/11/1978.

2)The Indian Evidence Act- sec 85.

What is the difference between Authentication & Registration?

If SRO is not willing to register/authenticate the GPA, can i Notarise the Document (GPA)?.How it is viewed in the EYE of Law? I mean is it Valid in view of LAW?

I request Expert of the Forum to clarify my doubt.I am from Andhra Pradesh State.

cheque bounce by a friend inspite of paying hand cash

Dear sir,
MY FRIEND USE TO GIVE ME MONEY TO PUT IT IN MY ACCOUNT AND GIVE IT BACK IN CASH. I GAVE BACK THE MONEY IN CASH. AFTER THAT I TOOK SOME LOAN FROM HER AND GAVE CHEQUE AS SURETY, I PAID BACK THE MONEY BUT SHE NEVER RETURNED THE CHEQUES. I HAD GIVEN CHEQUES WITHOUT PUTTING DATE AND AMOUNT. NOW SUDDENLY SHE IS DEMANDING 30LKHS AGAINST 10 LAKHS, AND SHE HAS FILED A SUIT IN CIVIL COURT WITH ATTACHEMENT OF MY PROPERTY PLEASE TELL ME WHERE I STAND , HOW TO WIN THIS CASE.

which action will better

sir,
in 3/7 e.c.act the district magistrate passd an order(that the application which is filed by the respondent is fake so why any action not be taken against him ) during the pendency of prociding of confiscation .
what is the procedure to chellange that order?
and in which act the application will be given?

Section 498A - Where to apply for AB

I had earlier asked a question in this forum regarding harassment by inlaws and the learned members had very kindly given good advice.

I am a resident of Burdwan(West Bengal). I have recently been transferred to Bhubaneswar (Orissa) by my employer with my family. To safeguard against any misuse of 498A by my inlaws I want to take AB. My question is
1) Where should I apply for AB ? In Burdwan or Bhubaneswar ? For obvious reasons Bhubaneswar will be convenient. Please suggest. Whether the same shall be valid in West Bengal?
2) Am I obliged to my wife and inlaws about my transfer to Bhubaneswar or first I should get AB and then inform.
3) Where the further proceedings will take place?

Companies act

Dear All

Say X is a Pvt Ltd co. and accepts the money from Y Pvt Ltd. Y Pvt Ltd is showing it as an ICD and X Pvt Ltd is showing as a loan.
No agreement has been entered into between the 2 companies for this money. Now my question is whether it is a ICD or loan.
If we say it is ICD then the Pvt Ltd co. is not allowed to accept deposits from outsiders u/s 3(1)(iii)(d)
So how to prove that this is not ICD but it is a loan. It was carrying interest @ 12% p.a.
So what are the characteristics of ICD & Loan by which we can discriminate these two & prove that it is not deposit but it is loan.
Are any other provisions applicable for such transactions under companies act & whether any violation is made

gandfathers fathers property

my grandfather's father had some land and he, grandfather and my father died withour a will. My grandfather was only one son. My father- they were 4 brothers and 4 sisters . Five of them are surviving now. Please let us know we have any right in that property . If yes what will be our share %. We only know the place where we have land . How can / from where we collect complete information regarding the land. Please advise

Child Custody

Hi!!

Myself and my wife ar living separately for he past 6 months, I have filed for a divorce in the chennai family court, however my wife subsequently filed a petition for separation.

However my only daughter born on 27th Mar 2005 is inmy wife's custody and she hasn't allowed me to speak to my daughter telephonically nor meet her physically from the past 6 months.

However my petition in the family court is only for divorce and not for child custody as thought my wife would agree and allow meto have a proper relationship with my daughter.

However now my daughter who was closer to me then is very averse towards me as i think my wife and their family have poisoned my daughters mind. This i got to know once while i met her near the school and she did not wanted to come to me.

My wife is working employee, she works from 8 am to 8 pm, she is staying with her parents and my daughter is with her taken care by he maid servant and her parents.

I am currently engaged in a consultan since i lost myjob recently. However there is no issue on that irrespective of whether i have a job or not i can take care of my daughter at the same standards how i have taken care of her from her birth.

Now i am contemplating to approach the madras high court for child custody. Under current situation, what are my hances of getting the child custody and what would be the implications.
