Overpaid arrears

Hi

Three years back when i am in india , I was overpaid with arrears from the company where I have worked.. This amount was not identified by me ,and even
company didn't identify the mistake. Ater month's I have got job and left to US . All the amount in my account was spent for my personal reasons.


After three years the company came back and asking me to retturn the excess amount paid.Please advice , do I am liable to pay the amount.
Do the company have a right to file a case againt me.Currently I am in Us.

Sir, As per right register i come to know that my grandfather had purchased 1/4 part of x acre of agriculture land from (A)in 1939 and the same entered in GFname in 1946 for 1/8 partand 1/8partof (A) name. The entries at right register 1943 shows that he sold 1/16 part +1/16 part to M & N farmer of land. Mr.A sold land to B in 1944.The name of B entered by deleting name A in 1946.The name of M & N entered in 1946 refering previous entry with 20 survey no ommiting 2 survey nos.the land uncultivated for years to gather after death of MY GF till 1968.After death of my father in 1995 other farmers made entry for that ommited numbers for their heirs which not appoved till date in right register from any Mamlatdar but name entered in 7/12. Can I apply for the entry my family members name?

sir, My grand father purchased 10 acre of land in 1939.(40 acre of total). On record the mutation entry made (6/A right Register).Then in 1946 during land measurement for compilation of survey no the 5 acre land entered on his name and 5 acre in the name of the original owner name. The same sold to Z in1944 and entered on 6/A. I am holding the registered sale document and regisred mortgage deed from Z to my grand father. Can I claim the rights at present? How?

Tenant claimed as owner

A is a Muhammadan,he has a house property, for which he orally let it out on rental basis to his own brother B. After certain period B filed a caveat against A claiming that the house property has been orally gifted to him by his brother A. The possession also has been delivered to B and for the same B has accepted.
What are the legal remedy available for A to vacate B from his house?

Mental torture and harassment by husband.

Hi,

The girl is my friend Harshads sister who is a soldier and posted on the border. She is a well educated and employed girl belonging to middle class marathi family and was married 04 months back to well settled boy from same caste.

The husband claimed for Two lac rupees, On account of failure to bring expected dowry they by all means are verbally abusing the girl. If the girl tries to say anything husband threatens her. He tells her that he has unwillingly married to her (Marriage was fixed 4 months before the date of marriage) her parents have cheated him and now he will make her life hell
In recent incidence they forced the girl to carryout abortion in second month and soon after started blaming her for the same Parents are reluctant to come forward because of their appreciation that it may lead to victimization of their daughter.

The poor girl who is shocked by all this and my friends family are worried, they urgently need answer to this questions –
1. What is to be done as it is very sensitive issue.
2. It appears as husband wants to break the marriage but has a fear of society and hence wants the girl to walk away by troubling her; can he be legally stopped from doing so?
3. Will going for a legal action can help?
4. What if the other party try to misuse the law.(Mother in law threatens that she will lodge complain against girls parents or do fake suicide attempt and blame the girl)
5. Can going to ‘Mahila Dakshata Samiti’ will help?

1.what is principle of uniformity?
2.under what proviso SC frames issues on matters of wit petiton under article 32.Is order 14,rule 1 of cpc applies to SC while framing issues,when petion is under artcle 32.
3.Is it mandatory for SC to accepts the persuasive authority of lower courts.
