Pl. quote the relevant rules under formation of Will wherein executor and beneficiary must not be same person alongwith relevant cases.

pleading at consumer court continued

i am confused with answers received.

further,as a layman,i feel that one can fight a case at consumer courts within the frame work of consumer protection act only.anything beyond that doesnot comes under them.

as such a knowledge of consumer protection act and commonsense would be enough there.

i do agree that nothing would substitute the experience and knowledge of an experienced lawyer. It may all depend on the subject matter of the case.

Sill, i feel that the intention and purpose of the act was that anyone could represent his case at these forums with simple procedures.

Sale of vehicle in scrap

Respected sir, I have to sale my old scooter(1985 Model)and Maruti van(1991 Model)in scrape, Now in the wake of recent happenings, I have a fear that vehicle can be used in kidnapping/murder or in other criminal activities. what should I take in writing from the scrapewala and what will be the value of stamp paper. Since name transferring in RTO is tough as well as cstly. Thanks to all.

Regarding suit

If a property suit is filed without any valid cause of action, in such circumstances an application under Order 7 Rule 11 can be moved to court for dismissal of plaint. Pl. also mentioned other rules relevance in this regard.

Whether under a will the whole peoperty can be bequeathed in favour of executor?
Whether the benificiary and the executor of a will can be the same person?
Whether an Advocate can be appointed as an executor?

Percentage of setting aside the divorce cases in high court

Hello,
I would like to what is the average percentage of the divorce cases setting aside in high court. The divorce is given by family court and it was a contested one. what should be the reason one should give in high court to consider his plea to set aside the divorce given by lower court?

Hindu Succession Act

Under this act a case for partition of a only Dwelling House bequeathed to me by a unregisterd will of my father was been filed on me a only son of my parents whom I have lost in 1996. They hav chanllenged the will while probate and got succed.They were diriected as per 2005 amendment they are entiteled even though the case was pending in High court for more than Ten years.Now please guide me wht I hav to do. Ihav proved the genunies of the will by 4 witness but it was ignored

What does it mean by Restoration of Divorce Case?

Hi,

I would like to know what does it mean by restoration of divorce case? For example if family court grants the divorce to wife and husband challenges this order in high court and high court restores the divorce given by family court? Does it mean the earlier divorce given by family court is temporary set aside or the complete order is reversed cancelling the divorce given by family court?
