Dear Sirs
one got a car loan from SBI he was default in his emi subsequently the recovery dept took the car with out his knowledge and then he paid some amount .after getting the amount the bankers sold that car with out any intimation to the first owner to another bank staff (SBI) FOR CHEEP AMOUNT now the first owner is having the original registration certificate and bankers filed a suit for the balance amount and asking the original registration certificate
Is there any possibilities for the first owner to hold the car if so kindly guide or he simply skip the matter with out answering the suit filed by the bankers?//

Dear sirs
Is there any provision for a Bank to avoid hi court summon(stay petition for eviction) against having an eviction order from CJM court for both eviction and police protection . the question is can the bankers avoid the summon from the hi court stay , verified with hi court circle it says banker did not received the summon which is been S R numbered in Hi court ,Is the Bankers playing to implement the CJM COURT order by avoiding the summon . In this situation how can the Borrow er defend their selves??????????????----------------------------------

look friends we all know that legally divorce takes time and if we are seperated than how can husband get rid of wife who is not giving divorce and having affairs ouside.

Dear sirs
After getting evicted for not paying the rent from a possession ( with the help of court order & police) he is financially Nil , how can he defend himself from the land lord who is trying to file a case to collect the arrears rent from him ,with out giving an I.P

Hi,
I run a partnership firm with 2 others and am stuck in a sticky situation where one of my partners has been involved in frauds and what to ask him to leave .However do not want this to cause any obstruction in the working of the company.
He has not signed the partnership deed with us.
However his name is mentioned as a partner in the IT files.
Can he claim anything from the company or obstruct its working.

i am living in a apartmentin kolkata. the land lord has stopped accepting the house rent from me. when i tried to deposit the rent under rent control act, i was turned away saying that my rent is above 6500/= whiach does not fall under this act and was asked to file a case under T.P. act. Please panel advice on the whole

i have a property which has been in the adverse possession of some persons. now the property has been acquired under land acquisition act. who should get the compensation. the title deeds are in my name but the 'adverse possession' for the last 20 years is with someone else, as decided by the high court. in land revenue records the name of my predecessor in title is there but not that of the 'adverse possessor'.

MY REAL SISTER( A GOVT SERVANT) PURCHASED A RESIDENTIAL PROPERTY IN PUNJAB IN YR 2005. THE ENTIRE LOAN HAS BEEN REPAYED WITHIN THREE YEARS AND NOW THE PROPERTY IS FREE FROM ANY MORTGAGE. SHE WANTS TO GIFT ME THE SAID PROPERTY . MARKET VALUE OF THE PROPERTY IS APPROX 13 LACS. PLEASE INTIMTATE IF SHE CAN GIFT ME THIS PROPERTY ?.
MY QUERY IS;-
A] CAN THE CONSIDERATION VALUE BE SHOWN AS ZERO . AND RELATED STAMP DUTY ON RS 13 LACS , TO THE GOVT CAN BE PAID BY ME ?
B] MY TAX LIABILITY AND ANY INTIMATION REQD TO BE GIVEN TO THE IT DEPTT?

In continuation of my earlier query on 11 Dec 09 on the same case.
In case the court orders the passport authority to impound/ cancel the passport, what will happen to my uncle? will he be arrested and brought back to India? If we challange in high court as this is only an allegation by my aunt, will the lower court order be set aside? should we tell our uncle to come back to India loosing his job forever as we do not know what would happen when he comes to India? wheteher he will be able to go back?
can the members help us to come to some conclusion on this matter at the earliest

Industrial Unit in RIICO- Bhiwadi-Rajasthan
I am NRO living in Kuwait sine many years. I applied and got a NRI quota Industrial Unit- Plot of land for a factory in RIICO- Bhiwadi. I paid full payment for the plot a few years ago. As per terms I was supposed to finish construction and show production from factory. I did not construct nor show any production. RIICO penalised me for the delay and gave me 45 days time to construct and show production from factory.
My query is " how can I obtain resonable time to construct and show factory with production of AUTO parts.
as I am living in Kuwait and a heart patient, I need advise on how to avoid the cancellation of the PLot as threatened by RIICO.
I await good advise and help in this matter. I will come to Delhi and RIICO in january 2010.
