Hi sir,
I am Ravi from Bangalore. I have been married for 7 years. We are living separately now. We lived together for very short period of time. We have 5 years old boy.
We have a lot misunderstanding and can not live together. She is not ready for divorce. She is working and earning more than me. She has bought a house. I don't have any properties on my name other than band deposit.
I am mentally disturbed and suffering from stress, depression etc because of our problem. Now she is not ready to come and stay with me. Even she also doesn't allow me to visit my son and visit her. Now she is saying i am mentally ill and so that she can not allow me into her house as well as she can not come and stay with me.
For small reasons, she used to abuse me like i am mental and good for nothing.. So in the heat of argument i have beaten her.
I feel there is no point in living like this. Because it has been seven years we are living like this. i am nearing 40 years. Now I need to think about my future also.
Please advice me what should I do?
1) Shall I go for divorce? . But she is not ready. I heard divorce processing in India take s 2 to 5 years depends on the case.
I don't have enough mental strength to fight for a long period.. If I file divorce case, she may file dowry and harassment case against me.
We went for counseling many times. But nothing worked out. She keeps blaming me and abusing me if some one asks why she stays separately from me.
2) Shall I go and live with some one with out marrying
3) As i am suffering from me stress, depression etc, i am not able stay alone. i need some one with me. If I stay like this , I will become mentally ill and will lose my job. I will be useless. Is there any way I can use this to solve my problem.
Please consider me as your brother and advice me.
Thanks

I have purchased a property( land ) with the finance from a bank after varifing all the documents & search report .few months later a relative of old owner filed a suite of T.I.against me stating that a partition suit including this property is pending in lower court since 1998 & he also has share in this property.
he asked the court 1) to decleare this sale deed ab initio void
2) not to demolish old construction & not to allow new one
3) not to transfer this property .
After varyfying all the documents, court has said that, there is no primafacee evidence showing plaintiffs share in this property .also just because the partition which took place in 1992 was oral partition, other entries in the govt record should not be neglected . Also the partition was accepted by plaintiff's father & was entered in govt revinew record.
court has ordered that 1)I can demolish old building & start new construction on the said land
2) I should not transfer the property.
3) I should give undertaking that if at all the final decision goes in plaintiff's favour,I will demolish my construction & bring back to original one.
This order is till the final decision of the suit & not intrim
As said earlier the land is mortgage with bank since purchase.I have taken permission from local govt authority for construction.bank is ready to finance me.
My query is-
1) Do i need to take permission from court to increase the loan or mortgage ?
2)will that be contempt of court otherwise?
3)As mortgage comes under transfer of property, what difference is between mortgage & transfer of property?
4) will court allow me to increase mortgage?

Help: Accident, complain against me
January 10, 2010
around 15:15 Hours
At the turn towards a mall where i was going a Bike was trying to overtake me from the LEFT. It had one pillion rider.
My speed was 10-15 Kmph as i had to turn left.
They got minorly hit. Nobody was hurt a very small scratch on the bike which was not even visible.
There was a slight arguement which got over in 2 minutes. They did not claim or say much then.
I was in the mall for about one hour. Then when i came out he came and said his bike is in bad shape and he has lost his mobile phone as well. I said you were over-taking from the left and i was at a very slow speed so its your fault and i am not responsible for your phone.
He said he will lodge a complain and i said ok fine its not my fault so i will not pay you any compensation and I left.
what if he lodges a complaint against me now? What can i do if he does so? What should I tell the police?
please help
regards
Hitesh
