one accident took place and in that accident two vehicles were involved one is Motorcycle duly insured and one Honda City Car also insured, now the problem in that the person who was riding the motorcycle is died and offence is registered against him by the Police, and since the offence is registered against him he cannot claim compensation by filing claim petition, since offence is registered against him by showing he was rash and negligent, can claim petition in this case be filed only under section 163A of Motor Vehicle Act?

Whether sales tax returns can be used as an evidence to prove that the turnover shown by the assessee is the final figure and department can not disbelieve the sales figure derived after deducting cash discount.
The I T Deptt. is relying on Cash Memo where discount has been allowed manually and name of the customer is also not mentioned.
Respected seniors,
Please recall me the exact provision or section in which Genuineness of document is admitted as writing on it "Formal proof dispensed with". Sir what is the proper way to write, that in future it may not affect us. I have seen many judgment in which in appeal It bears a adverse affect. Proper word is "Formal proof dispensed with" or " Genuineness of the document is admitted" or " The genuineness of document admitted but facts are denied" ?. What is it's evidentiary value.
Sir I couldn't understand the " Advocate on record". What is it ?. Who is recorded?. What is it's relevancy?
Sir my client is facing trial under 409,467,468,471 IPC from 1999. He was a bank employee. He is charged with embezzlement of Rs 8 Lack, by withdrawing money from the accounts of account holders. He got bail after one and half year.
In trial no account holder said that he embezzled his money, they said their money has been paid to them from bank, they give only hearsay evidence against him. There is no opinion of hand writing expert. During the period for which he is charged, three departmental audit took place in which no irregularity was found and bank was provided with grade "A".
He has spent one and half year in jail and got terminated.
Please refer some favourable citation and points.

Cheque Bounce
I had received 3 Cheques from a Real Estate goon & it got bounced, case going on right now. We have done with our side & now its cross examination of the accused. He has filed a affidavit that we bring in rowdies to threaten him & have colelcted cheque. What is that we need to do now ? How to get evidence that we have not done this ? They have claimed that they went to the police station to complain regarding this but they did not accept the complaint ? I feel indian law is too loose, allowing this kind of false accusations without proof. I am worried about this case, please suggest next steps. My lawyer is doing his best, waiting to see what happens.
