How is interest calculated in cases involving money, example recovery of money.

Is the interest calculated from the time I lent money or from the date of filing the case. And also after the judgment if there is still time for the borrower, how is the interest calculated and what rate.

What is commercial rate and when is commercial rate used.

Procedure

When is cross objection under O 41 R22 filed instead of an RA or RFA. What is the difference betwween the two and when is one chosen over the other. What is the difference in effect if any in chosing one over the other.

Labour

I am confused with the definition of Workman. It seems most of the labour laws deal with Workman. Can you pls help me with a simple yet comphrehensive definiton of WORKMAN. Does the IDA, ESI, WCA, EPF, Factories Act, MWA apply only to WORKMAN. What about bank employees, teachers, government servants, private sector employees (software, consultancy, etc). Does any of this apply to them. Pls provide some comprehensive answer

Jurisdiction

I am confused as to which cases come before labour court and which before industrial tribunal. Can you pls explain the difference between labour court and industrial tribunal.



Also in the case of dispute of a software employee regarding dismissal, retrenchment, which court does he approach, since the industrial disputes act deals with Workman and the software employee is not a workman. Can you pls provide some comprehensive details on this.

SECURITISATION ACT

MY QUESTION IS THAT IF THERE IS A SEPERATE REMEDY IS AVAILABLE TO CO -OPERATIVE BANKS UNDER THE ACT (LIKE GUJARAT CO OPERATIVE SOCIETIES ACT) TO TAKE ACTION FOR RECOVERY OF AMOUNT AGAINST BORROWER,
IN THAT SITUATION CAN CO OPERATIVE BANKS CAN TAKE RECOURSE OF SARFEASI ACT FOR RECOVERY OF THEIR DUES?

I have a claim case in which a clerk of contractor was injured in a road side accident when a tractor hit his m/cycle from back side.Regd. owner of M/cycle(non-offending) on which injured was going at the time of accident is in the name of contractor i.e. employer of injured.Police registered crl case (FIR)against tractor driver & offending tractor was taken in possesion by police.Now i want to know whether it is necessary to implead contractor i.e. regd owner oif m/cycle as party/respondent alongwith driver,insurer & regd owner of tractor.kindly help
