EPF Act 1952

Is the employer bound to pay 10% as employer's contribution irrespective of the level of income of the employee? Or do we have a ceiling for such income say Rs.5000 or Rs.10000.

EPF Act 1952

As per the Act, apart from factories establishments which Central Govt. may notify would be covered under the Act.

My queries are:
1. What all establishments have been notified by the Central Govt. on which the provisions of the said Act would be applicable?
2. Does employer in other establishment is at sole discretion whether to follow or not to follow the provisions of the said act?
3. Is the minimum limit of employer contribution 10% in all cases? Then why does the employer contribution in only excess of 12% rather than 10% not allowed as deduction?

Is an article assistant an employee?

Please confirm if an article assistant under the ICAI Act also an employee as per the following Acts:
1. Income Tax Act, 1961
2. EPF and Misc. Provisions Act, 1952
3. The Payment of Gratuity Act, 1972
4. The Payment of Bonus Act, 1965

P ltd sold goods to Q ltd at a value of rs.500 per unit. in turn Q ltd sold the same to r ltd at a value of rs.600 per unit. if p ltd and q ltd are related, where as q ltd and r ltd are unrelated, determine the value on which excise duty is payable..

Can any one please help me to solve this and compute(i)Assessable value(ii)Customs duty:

A imports by air from USA a Gear cutting machine complete with accessories and spares.Its HS classification is 84.6140 and Value US $ FOB 20,000.
other relevant date/information:
(1) At the request of importer, US $ 1000 have been incurred for improving the design,etc.of machine,but is not reflected in the invoice,but will be paid by the party.
(2) Freight-US $ 6000
(3) Goods are insured but premium is not shown/available in invoice.
(4) Commission to be paid to local agent in India Rs,4500
(5) Freight and insurance from airport to factory is Rs.4500
(6) Exchange Rate is US$1=Rs.42
(7)Duties of Customs:Basic-30% CVD-14%

property


i have given my house in security (Called JAMANET)in court in favor of my sister in Law .

Can I eligible to sales this property at present.

What are the consequences if i sell this property?

Can I inter in to agreement of sale in the property with out court permission.

Or with in agreement I will give the possession to that property

Adoption

Sir,
My grand Mother (mother's mother) has got only Son ( mother's brother). My mother(60) got one younger sister(58) and elder brother. 4 years ago my uncle(my mother's brother)died. He has no children but carried away with wife who left him for 30 years. After his death Uncle's wife came into picture and started acuiring the property. Though she is not divorced but there was evidence that she was seperated from his Husband. Then my elder brother took this case in hand he fought for the property. In between he forced my grand mother to adopt his son( 16) and made her to write that all the property will belong to his son and that document got registered in the registration Office. In the Document My mother and her sister also signed as withness. Actulally they got an wrong Impression that after winning the case my brother will sort of the issues and he will distribute the property among us. But the case result came as the property shuld be devided two parts. 1. to My grand mother and 2. to my uncle's wife.

Now my brother is keeping quite that he is thinking the property will come to his son after my granmothe's death or his son maturity.If we ask him about the property he simply saying that he can do nothing untill the property comes to his hand. His intention is clear that he want to get the whole property.
Please suggest me how to resolve this issue, so that the property should be distributed among my mother, her sister and my Grand mother's(she is still alive but not so conscious) adopted son( My brohter's son.).

land partition

Sir,

My father- in- law who's name is Sridhar Rao,got 20 Acres of land got from his father. I married his daughter in 2004. He got 4 daughters and one son. My wife is youngest. Recently my father-in law sold part of his land i.e. 2 Acres to his third daughter for which he got a flat from them, without intimating us anything. Is is possible to sell his land like this? if not what are the ways to approach and get the details?Has not my wife got any relation with that land? pl. help me.

Life Insurance

Hi,
I have a Life insurance policy for Rs 50 lakhs. My wife is the nominee and eligible for 100% of the proceeds incase of any unfortunate event. But we do not have any proof of relationship like ration card , voter ID and marriage certificate.

Will the follwing proofs be accepted as relationship proofs ?

SBI passbook- joint account with me
My passport - wife name mentioned and wife has pancard to prove her identity.
