Sir,
If the husband is staying at her parents house and wife filed 498A and separated. Can wife claim divorce on the grounds of Cruelty and desertion.
Recently there was a Supreme Court Judgement regarding divorce on the grounds of desertion. "Spouse leaving the matrimonial home does not amount to desertion"
Please kindly tell me the judgement when it was delivered. When desertion is valid.

when objection against exemption under limitation act raised by defendent is made after issue is framed or when the plaintiff file plaint to get exemption ?

Would our experts clarify on the following issues in respect of a will?
(A) A testatrix makes a will in respect of a property ownership of which did not vest in her either at the time of making the will or at the time of her death. The property was allotted to her by a housing board. The property was held by her on lease cum sale basis, and the consideration amount was to be paid over a period of 10 years. After receipt of full payment, the Board would execute the sale deed. An agreement of lease cum sale is entered into between the board and the allottee. As per the terms of the agreement, the Board could rescind the allotment if there are outstanding dues or for breach of any other terms therein. The ten year period is up, and there are still unpaid dues. The testatrix makes a will in favour of one of her 6 legal heirs and dies. The board has sent a due notice with a warning that the allotment would be revoked if the dues are not paid within a time limit. Is such a will capable of being probated? The other legal heirs are unlkiely to give consent for the probate.
(B)The other legal heirs have filed a suit for partition? Is the suit maintainable in the light of the above facts?

What is the concept of Writ Petitions ?
In my case,
MCD (Lessor) is not giving permission for Sale of half portion of a Leasehold Shop to third party.
Whether Lessee can file a Writ Petition in High Court for against this ?

Greetings,
I have recorded the voice conversation of my spouse speaking to someone in a extra marital relationship.
Is voice recording on the mobile or recorder stand as a proof in the family court in a divorce case and what proof has to be presented besides the recorded voice.
Also is it possible in this matter to obtain a recording from the mobile company for the past many months or years and what is the procedure. Does it stand proof in the court of law and what has to be produced in court besides that.

My Wife Had filed case in family court for restitution of congugal rights in family court & Maintenance in family court.
now today she had again filed case for DV act 2005
now i wanted to know whether both these case can run because in both she is asking for compensation
can u let me know more on this how should i avoid DV & let the case be continue in Family court

I am working in service industry, Please let me know what are the necessary steps or components a Co. has to pay at the time of retirement of employees acc. to the shops and establishment act, Delhi.
This complaint is regarding a homeopathy clinic named Nash Homeoplex located at various places in Mumbai.
I was a patient at Nash Homeoplex for the entire last year 2009.
I had joined Nash for my skin problems.
I am finding myself cheated as the ASSUARANCES of curing my skin problem given to me before the treatment are not fulfilled( not a bit ) till now even on the
completion of the treatment of one year.
Nash Homeoplex has cheated me by getting me enrolled for treatment by giving false promises and COMMITMENTS of showing the start of the results within 3 months of
enrolling after paying the entire fees.
Nash Homeoplex has not delivered a bit of the results they COMMITTED.
I want to file a case against them.
As usual they had not given their commitments in written and so they are now shedding their responsibilities claiming that they are not responsible if the
treatements does not show any improvement as they had not commited in written.
Anyway I have a voice recording( during my third visit ) of the doctor taking responsibility.
During the first visit the doctor had made tall claims and took the responsiblity which I did not recorded as I believed them as they were taking responsibility.
During my second visit I paid partial payment.
During my third visit I paid the remaining amount. At the same time I took a voice recording of the doctors satatements in which the doctor has again said that "Yes I( the doctor) had given the assuarances of curing the skin."
Can this voice recording be considered equivalent to a written assuarance and help to make my case stronger and nail nash homeo.
So anybody can please let me know how string is my case against Nash?

OR SHOULD I THINK OF GOING ABROAD FOR A CAREER IN LAW?
