final settelment dispute.

Dear sir, kindly advice me on final settelment dispute.

As per company policy (appointment letter which I singed) employee have to work in notice period of one month OR pay salary of one month (pay inlieu).
Sir, I resigned on 1st Feb.2010, and worked up to 6th Feb.2010 (I will to complete my notice period), but company blocked my last month salary (i.e Jan.2010) in which I worked full month. On the dated 8th feb. I came to know company blocked my last month salary, after enquery I came to know that HOD (General manager) given instuction to account and HR department about should not doposite Jan. salary.
And on the date 08th Feb I refuse to work in notice period because without salary it is difficult for me to servive for 2-3 months [i.e Jan, Feb, March without salary (final settelment have to take 20-25days after completion of notice period means my tentative final settelement cheque going to issue on 20-25th March)].
I requested HR manager to compansate my pending leves (32days including PL,CL,SL) or deduct my salary for remaining days of notice period but till date company not given me final settelment.
Ans now HOD & HR saying that you are not handover your charges so we will not issue your final settelment cheque until charge handover. But sir in my resignation latter I clearly mention that “Let me know my replesment to handover charges” but up to 8th feb. HOD as well HR not given replacement,
So, please tell me in this situation what should I do and advice me for further step.

Thanks in advance

False Petition for restitution of Conjugal rights by husband

When my sister came to paternal home in Mar'2009, she explained all her agony due to continuous DV by her Husband & mother-in-law.We requested her husband to come once for discussion & to solve the matter, but he denied and instead filed a petition for RCR in a family court which is in a different state (The boy works at that town and he is a daily passenger from my sister's matrimonial home. He stated a lot of false info in the petition like they live in that town in a rented house and etc etc. Whereas in 3 yrs of their marriage my sister has never gone to that place.
But instead of taking any legal step, we decided to go to his home with my sister with some of our gurdians and to save the marriage by discussion.
He agreed to stop DV & to settle the RCR petition infront of everybody. Ever since, my sister is staying with her husband till date. But he has neither stopped DV nor settled RCR.
What should I do if
(i) I want to take extreme legal action against him?
(ii) stop him legally from doing DV & to keep peace in their married life so that my sister does not cry ever after?

Inheritance by married bengali hindu daughter.

If my father dies without making any will , can I suit partition for my share in my paternal property -a dwelling house where my brother and his family lives? If they refused to give me my share what actions can be taken against them.

Do I have any right to live in my paternal house by seeking partition after my father's death? My mother has died 21 years ago.

sets of proofs provided are gien to the opponent?

Dear experts,
Mr X is facing a false complain and may be required to pass through the regular bail process. The query is: Will the complainant's advocate be given the copies of all proofs by Mr X's (advocate) to the court in the bail process.?
If yes, then what is the remedy for the same?

consequences of compromise in a case registered under IPC279

A false hit and run case has been registered against me under IPC 279. The complainant is interested for compromise in criminal case. I would like to know the consequences of the compromise. Would a compromise mean that I have committed the crime? Would the records of Police reflect me as a criminal?
If a compromise is made, what would be its effect on the ongoing civil case against me which is on the verge of conclusion (only three or four dates remaining). I was and I am having a valid driving license and insurance policy since the date of accident reported by complainant.

Death Claim Petition

A mohammedan expired died intestate leaving behind his wife,3 minor childeren, one major daughter and mother. He was waving a gold loan account with a bank. The legal heirs above mentioned moved a application to redeem the gold ornaments in the name of the deceased mohammedan.

The problem is there are no apparent "Natural Guardian" to act on behalf of minor childeren in this case and hence bank find it difficult to release the gold ornaments to legal heirs. The father of the deceased died intestate without appointing a gurardian for the minors.

Apart from going to court to appoint natural guardian for minors,is there any way to solve this as to release the gold to mother of minor childeren.

what adequate proctection the bank has to take to release gold to mother ie:wife of the mohammedan
