i am a lawyer on plantiff side therewas land 4.30acr we get that land from my father.def get possestion of 1.o3acr by way of orat leasein 1973 plantiff want possestion def not givenwe make a case for possestion.def plea is that he get that property by way of will which plantiff father made in his favour, his plea ,he was son from another father after death his father his mother marries the plantiff father both plantiff def ,mather ,father was living togetherewill i make a amendement for declaring that will was bogus ,fraud

I filed suit for money recovery of 31 lakhs from a registered partnership firm. The firm entered into MOU with 3rd party to dispose off its property. I filed for interim injunction O.39, to restraint firm form selling the property so that my recovery will not be affected. Summons were served on the respondents, i.e. firm & partners and order of injunction granted. However, during pendency of this litigation between the period of filling and order, firm sold the property along with all its machinery for 55 lakhs., now firm is only a name with no assets, and also no money, as money received is very little and used to pay secured creditor. Transferee has now mortgaged the property for 1 Cr. to Nationalised bank.
Will the principal of les pendend apply, will contempt apply what are my recourses,
Please help with advise.
Whether Succession Certificate alongwith Legal Heirship Certificate is sufficient enough to claim dues from Government with regard to unpaid arrears pension due to the deceased?

certain retired employees of a corporation seek the enhanced ceiling limit of Rs 3.5 lac to Rs 10 lac as prescribed in the 6 pay commission . these employees are covered under central dearness allowance(CDA)
. some employees of the same corporation who are covered under induatrial deraness allowance(IDA) have been given the benefit of the above mentioned ceiling . it is said that for the IDA pattern no amendment is required in the Payment of Gratuity Act while for the CDA pattern an amendment is necessary. Correspondence was exchanged between the employees , the ministry and the PMO but in vain. Is there a case law to support the case of the CDA governred employees saying that the act of the corporation Article 14 of the Constitution of India ?

In which act it is said that if we submit the affidavit to the high court or high court related matters we have to start the first line of drafting of the affidavit as "In the matter of & in which act it is said that if we dont have to submit the affidavit in high court or high court related matters we have to start the first line of drafting of the affidavit as "In the matter of the petition of
What do u mean by every affidavit shall be drawn up in the first person.(if the abovementioned line is written under the affidavit for any purpose).

If the state government says that the tax on any things will be rs. 200 as an example but as per the Indian consitution, 1949 the tax should not be more than 100 so which tax rate should be followed?
Meaning of pecuniary limits as per section 6 of the civil procedure code, 1908 & what the section says.
Pls give the case laws if any

MY CLIENT HAVE AGRICULTURE LAND IN VILLAGE, MY CLIENT MEASURE THE LAND WITH SURVEY OF GOVERNMENT THE SURVER SAYS THAT THERE ARE MISSING THE AREA OF 2 BHIGAS AND TELL THAT IN OLD SURVEY NUMBER THE LAND WAS GOING TO ANOTHER SUREVY NUMBER FOR GHETHERING THE LAND SO MISS 2 BHIGAS AND GOING TO SOME ANOTHER SURVEY NUMBER
IT IS POSSIBLE THAT IN OUR 7/12 RECORDS THE MESUREMENT IS SHOWN BUT THE MEMUREMENT ON LAND NOT FOUND OUR TOTAL RECORDED LAND.

Dear Sir,
I have a child of age 3 yrs. My in laws took my wife and my daughter 3 months back showing me a search warrant, as only since 5 days from 3 months back my kid was with me for a holidays!
Now since that time they didn't let me to talk or to see or to meet my kid. I didn't have any marriage certificate nor married according to Hindu marriage process(Like phere and akshada and mangalashtake). Can i say that my child is illegitimate and ask for her custody? As i consulted few lawyers in Pune and they told me that I can say that i am not married with my wife and only we had live in relations.
In the past one case is pending against me in the court (Since last 3-4 years bur not a single proceeding till date). will it affect on to get the custody of my child to me? Please help me. They all people are totally uneducated and will spoil my kid's future. If any case study like this is available please send it to me!

after death of my father my brothers got the property (agriculture land)tranfered in their name i am the only sister and married.
i want to know will they be able to sell the land without my consent
