mutation

If a property is mutated in favor of only a few legal heirs do the others lose their title to the property? can the property be mutated in favour of all legal heirs instead of only a few? if one gives an affidavit that he has no objection if the name of another heir apppears in place of the deceased owner, does it means that he loses his share/he has relinquished his share in favour of the other heir?

Addition of Surname in school.

R Sir..My doughter was born Madhya Pradesh before 9 months ,at that place Born certificate issue without Surname as per MP rues But I m living in Gujarat so without surname i m facing problem at school admission..I hv Nottorised affidavite after 2 months of born mentioned this certificate read with so..surname..Give me suggetion..Thanx in advance

Right to Education

As the historic Right to Education law comes into force today, Prime Minister Manmohan Singh, in an unprecedented move, addressed the nation on the law. “The government pledges to give education to all children. It will make our children capable citizens,” the PM said.
“I call upon all state governments to join this national effort,” he added.


LAWMAN'S VIEWS


At the same time it should not allow politicians to mis(use) this law in the name of announcing Education related sops in their Election Manifestos

The issue is will it not pave way creation of more Educational Institutions mortgaged to private players in the name of this law?

Common Challan for depositing EPF and ESI contribution

Hi All,

I learnt that henceforth there will be a common challan for depositing employers contribution both in respect of EPF and ESI but alongside even came across some views that still the EPF authorities have not consented to the same.

When the directions have followed from Labour Ministry then is it required that PF Authorities should consent to it?

Will-Mutation

Dear Experts of Forum,

A person from state of A.P , got the property through an unregistered Will.Can he assume that the property he got is by succession . If yes, can he ask Tahsildar ( M.R.O ) to mutate the same in Revenue records on his name by virtue of A.P Revenue rule,quote,

"As per section 4(1) of the Act, any person acquiring by succession, partition, purchase, mortgage etc. any right as owner, pattadar, mortgagee, occupant etc. shall intimate in writing his acquisition to the M.R.O. within 90 days from the date of such acquisition ". unquote.

If this is not proper way, What option he has to implement the WILL and get the mutation of the property ?

income tax on property purchased

dear sir , i have recently booked 2 flats of around Rs 19 lacs for which the payment / loan has yet to commence , the flats are in my name as first applicant and my wife as second. my query is that should i book one of the flat with my wife as first applicant and will it have any financial bearing at the time of disposal of the flats. We both are PAN card holders.

Recovery Suit

We have sent a legal notice asking for the outstanding payment, it was recieved by the other party and a reply for the same has been sent to us.Tell me when will the limitation period will begin to run for that from the date of sending the notice or from the date of recieving of our notice by the other party or from the date of our recieving the reply from the party and what is the limitation period.
