Hi,
I am happy to take help from a pool of experts.
I need a little clarification related to succession certificate.
My father was an APSRTC conductor in Hyderabad and passed away few months back.
He has not updated nominee details with RTC in the nomination forms. But they have our family members details available with them.
(as we used to get medical claims, and RTC passes for tours)
(There are no legal issues of any sort related to family members)
On Family members certificate issued in MRO office, we received PF, graturity and other claims.
But they have one more FUND (SBT , may be specific to APSRTC), for that in obsence of nominee details they need succesion certificate
(because of their by pass law).
In normal cases the claim amount will be around 1.1 lakh Rs/-.
But as my fater has taken a loan of 70,000(out standing) we may receive around 40,000 RS/-
In the succession certificate should we mention 1.1 lakh (as that is the claim amount) or 40k as we are receiving only that much?
If we have to mention 1.1 lakh then we may need to file in heigher court.
Thank you for ur help.
Regards,
Manohar

Please help me by giving a format for filing a Memo for Cost of Adjournment in a District Consumer Court. I also need a format to file a Memo for requesting the Court to rule a 'No Say' against the opposite party as the opposite party has not come to the court even after 5 adjournments to file a version itself. Please also let me know if any document or support is to be filed along with the memo.
I also have a query if I can file a Memo for cost of adjournment for adjournments given on previous 3 dates.
In case it is not possible to write it as text in this page, please attach a file or upload the document to the uploads section or you can mail me at ipraveen@yahoo.com.
I will be greatly obliged for the help and many thanks in advance.

My father has a property which is occupied by him since 1960's without any legal document such as saledeed or anything else. recently city civil court has given an order in our favour on notice u/s 3z (2) of maharashtra slums rehablitation act, saying that the construction of the property is before 1970 and therefore BMC cannot demolish this property. the property is standing on private land.
My father now wants to transfer this property to me, his married daughter but is confused as to whether make a proper sale deed or gift deed in my name. there are documents such as assessment bills, the above order of the court, electricity bills etc. to show that this property belongs to my father. the property is in slum area and is used for commercial purpose by my dad. please advice as to which deed shall he make, sale deed or gift deed to transfer this property in my name.

There is a lot of confusion about the definition of ancestral property. Lets say X and Y are brothers and inherited and shared all their immovable property from their father. After X, his property passed to his only one son X1 , then to his only son X2 and then to his only X3. Four generations are completed and no partition happened in all four generation because of having lineage is of single sons. No person from X to X3 acquire any other property externally and added to the property.
In case of Y, story is different. Y had two sons, Y1 & Y_1. They distributed it by a will. Y1 had two sons again. Y2 and Y_2. They also distributed it by will from his father. Y2 had again two sons. Y3 and Y_3. They also inherited and distributed their property. No person from Y to Y3 did acquire any other property externally and added to their property.
Are the properties of X3 and Y3 individually can be treated as ancestral property?

What is the legal action that can be initiated for the above act of the complainant.

Do the above acts have retrospective effect on old loans prior to introduction of these Acts?Probably we would not have borrowed if these acts were prevailing then. Now suddenly the banks have been so aggresive needlessly by virtue of these one sided laws that it is impossible to counter them.Has this issue been settled by the Apex court?
