My friends mother has registered a will giving her house and vacant piece of land to her and her sister and leaving out her son (maaried and living in USA) on the gronds that he has not beeing supporting the family in India. Two daughters are unmarried. The property was built by the mother's earnings.
Now the brother is forcing the mother to give him also a share of land or bldg. Is it better to get the property registered in the name of daughters as gift from mother to avoid any further complications later on? Can the will be challenged by the son?

Respected sir,
Corruption in my town in land & revenue dept is in peak. In a frivolous demarcation case, when I refused to pay anything order passed against me, which contains so many procedural and technical mistakes rather some are blunder and everything is ante-dated, manipulated. Now as advised by this forum I filed appeal to the appellate authority within time. The appellate authority was not admitting the appeal, but after some argument it got admitted. Now here also they (officer) are demanding huge bribe directly. I have filed all the true copy of the documents of lower court. Now If I refuse to pay they may throw it away, I will be left with no paper. Next appellate authority has the same story. I am already disturbed a lot also going thro’ financial constraint, since I am an unemployed person. My father too is retired depends on pension. We have so many liabilities. Whole state of Jharkhand is neck deep in corruption. I cannot rely on state vigilance and state CBI. If I approach them and got back stabbed by them, then I will land up in a big trouble. And if my property and my life can eradicate corruption then it will be a big thing. Everyone is suffering, paying, and crying but no one’s complaining. Some of my well wisher lawyers say that never go against the tide. Civil suit will solve my problem but what is the remedy of this type of corruption? Who will bell the cat? Shall I write/approach CJ of HC or SC in this regard? Do we have right to live with dignity and self respect or not? Will they keep on sucking our blood like this?
Plz. Suggest. Thanks to all.

Sir,
A Brahmin priest on the back of his ancestral house established a personal temple, and after some time he opened it for “Darshan “ of general people also. He is by profession priest (Purohit). Also he received a land in gift for upkeep of the temple from one of his “Yajman” (Client). Some people are trying to take control of it so that they can enjoy the property of it. Will his temple come under religious trust act? Has it become a public property, it is an extension of his house? What are his right over the land he received in gift?
Plz. suggest.
Thanks to all.

Dear experts,
On 12-05-2010, i saw a news paper article quating that the appeal filed by the Private Schools Association of Tamil Nadu has filed a SLP before Supreme Court against the judgment passed by the Division bench of Madras High Court uphelding the Justice Govindarajan Committee recomendation regarding the fee structure for private schools. The Honourable Apex Court dismissed the SLP in the Admission stage. I try to get the rulings but i am not able to get that.
I request the experts to furnish the judgment for my perusal
I request all the experts to go through the ruling and sujest the parents to take suitable actions against the school which did not follow the decisions of Apex Court.

Registration Act 1908
I gather from the answers of the experts and texts of Regn Act 1908 that:
1. the sale deed entered in to between buyer and seller of a land above the value of RS.100 is a compulsorily registrable non-testamentary instrument.
2.the notification under 4(1) of LAACT1894 is a non-testamentary instrument.
In the event of both the instruments being related to the one and the same land and the first instrument being registered and the second being unregistered which one of the two will take effect against the other under sec 50 of the Registration Act which is as follows:
"50. Certain registered documents relating to land to take effect against unregistered documents
(1) Every document of the kinds mentioned in clauses (a), (b), (c) and (d) of section 17, sub-section (1), and clauses (a) and (b) of section 18, shall, if duly registered, take effect as regards the property comprised therein, against every unregistered document relating to the same property, and not being a decree or order, whether such unregistered document be of the same nature as the registered document or not.
(2) Nothing in sub-section (1) applies to leases exempted under the proviso to sub-section (1) of section 17 or to any document mentioned in sub-section (2) of the same section, or to any registered document which had not priority under the law in force at the commencement of this Act.
Explanation : In cases where Act No. XVI of 1864 or the Indian Registration Act, 1866, was in force in the place and at the time in and at which such unregistered document was executed, "unregistered" means not registered according to such Act, and, where the document is executed after the first day of July, 1871, not registered under the Indian Registration Act, 1871, or the Indian Registration Act, 1877, or this Act."
