Dear Learned members, here is a query for your which i need your help."A" given a laptop to the company for some defects as the it was under warranty. The company delayed the delivery of the laptop. After 3 months "A" filed a case in consumer forum and in reply the company stated that the delay was caused by third party as the laptop was lost in courier. My query is that. can a computer company take the plea that delay in delivery of laptop is caused by third party as the laptop was lost by courier company and it produced a certificate from the courier in this regard.Earlier the company did not informed "A" about this fact that the laptop was lost in courier."A" has received a new laptop but the case is going for compansation as he is MCA student and has suffered irreparable loss. Now i need some case laws and suggestion from you, thanks
Hi, My Wife got an exparte degree for the restitution of conjugal rights in Oct2007. But she did not turned up or shown the degree to me. In Oct2009 I applied for divorce. Immediately after receiving the divorce notice, she came and occupied my home, specifying in court, she wants to live with me. But actually she is harassing and threatening me. I have 2 question.
1. She threatens she will claim my property for not obeying exparte degree, specifying I am dishonest to court. Will this be possible by law?. I did not disobey, I allowed her to stay, but I am contesting divorce case as well filed a case to set-aside the exparte degree.
But she threatens through advocate, the exparte degree is sufficient to sue my property. Is this what law says?.
2. What is the maximum panelty to set-aside the exparte degree. Currently I got an IA number and following the exparte degree to setaside in court. But her Advocate, specifies me as fraud & dishonest in court and seeking for cost of my property. Is this possible as per law.
Please mail back. thanks Siva.

I had purchased a plot(before allotment) of Builder from secondary market(in the form of receipt) in Jaipur. 3 years have gone but builder has not done allotment and he has been already convicted in relation to this project only. Now he is alloting plots to those who are filing suit against him or putting pressure from various sources. Can I file a suit against him in Haryana ?

lis pendens, compulsorily registrable?
Is lis pendens on immovable property, compulsorily registrable in India?
If the answer is no, Why? What is the purpose or logic behind classifying it as non-registrable? How is a potential buyer of a land supposed to have had notice of any lis pendens on the land he intends to buy other than by knowing it from the registrar?
It is compulsorily registrable in Tasmania and many other countries
Tasmania:
Registration of Deeds Act 1935 (No. 24 of 1935)
Consolidated as at: 11 Nov 2006
26. Purchasers not to be affected by lis pendens unless registered
No lis pendens shall bind a purchaser or mortgagee without express notice thereof unless and until a memorandum or minute, signed by the plaintiff or his authorized agent, containing the name and the usual or last known place of abode or business and the description of the person whose estate is intended to be thereby affected, and the nature and situation of the property or estate intended to be affected thereby, and setting forth the title of the court and of the cause or matter, and the date when the proceedings therein were commenced, shall be left with the Registrar.
