Sir,
I was on the way from my office, one car
jumped the red light and hit my vehicle (Motorcycle) hence my left leg's two bones broken on 10.02.2009. I lodged the FIR in Sector - 24, Noida. The driver arrested and car was also taken into police station.
I had filed a case at District Court Greater Noida in august, 2009 through an Advocate in Noida.
My query is : I have been called by my advocate in the Court only at the time of filing. Approximately one year is approaching, however when ever I asked to my advocate he is saying hearing is going on. But not ready to give the exact feed back of my case.
Why the court is not called me or my witness even after 11 months completed from the date of filing the case.
How much time will take to final this case.
Please help me.

I was assured by the mediator for placement in big LPO after clearing QLTTb but now he left this industry and moved abroad. Now i want to know whether i am having good future in a corporate sector or not ? as well as is there any special place or immunity available to solicitor in Supreme Court of India or not ? Thanks

my father along with 7 other persons was falsely implicated in a case U/s 147, 379,506 IPC in the year 1984. My father got bail from the Hon'ble Session court in that year. Thereafter, nothing was heard about the case. The then police advised my father, the case has been closed.
Suddenly, now in the current month of June 2010, police informed that an arrest warrant has been issued against my father & other 7 persons relating to above mentioned case.
with the assistance of locals moharer, it has come to know that due to prolong absence i.e non-appearing in the Hon'ble Court, such warrant has been issued. The date of hearing fixed on 22nd June 2010.
I cannot understand the basis of the arrest warrant.
Please advise the steps to be taken to avaoid arrest by police.
What action can be taken by the police??
what is the way out??

I am owning a flat in a residential complex developed by a builder in Kandivli East, Mumbai. There are total about 500 flats and of this, around 175 to 200 flats have been sold and remaining flats are yet to be sold by the builder. He had taken at the time of booking 18 months maintenance charge along with property tax in advance.
Those who have completed 18 months are now required to pay property tax and maintenance charge as per rate fixed by him since society has not been formed. He has also passed on the tax liability on unsold flats to the occupied flat owners. Is he justified in doing so or can we refuse to pay?
He has also mentioned in the agreement that only one society should be formed for the entire complex. Since we do not know when the remaining flats will be sold, can we form society with the present no of occupied flats? He is also charging maintenance and property tax at the rate of Rs 5.50 per sft. Can we oppose this exhorbitant charge? Pl give your expert opinion.

Hello,
I am completing my LLB and will start practicing as an advocate next year. So, my enrollment will be effective April' 2011 for example.
Now, if I go to work for a law firm in 2012, I understand that I have to report this to the bar council and suspend my license. My question is that I want to appear for judicial services exams later. If I continue to work for the law firm until I take my judicial exams (example, ADJ requires 7 years of experience), will my law firm experience count, or will they look at my 1 year enrollment in the bar council and reject me? How is the seniority calculated for something like this?
Thank you,
Kumar
Divorce- Applied Fresh Case
(Did'nt get message for delivery...hence resubmitted)
I was an NRI and had filed a divorce case filed at subcourt of Tamil Nadu in 2002(got married in 2000). The case came for hearings in 2003 and have given my verdict that the Girl is unfit physically and mentally and threatened to commit suicide if compelled for intercourse. The subjudge listened and gave me time until next vacation i.e, after 6 months to appear back in court. Unfortunately i was not able to appear, hence the case was dismissed.
In 2004 applied for resoring, but my own legal adivsor who was fond of money, ruined by not informing the case hearing date hence that too was dismissed.
Have paid IA for case applied by my wife for 6months in 2004.
Now have applied HMOP case in 2007,without mentioning about old case of 2002. Now the reason menitoned here is cruelty and seperation. My wife applied for interim maintenance(no child) and court ordered to pay Rs.5,000 per month from 2008 to till date & continue until HMOP completes. And to torture she had applied for Maitnance case in JM Court and filed a criminal case against me and my parents by making false allegation that i told her before marriage iam a Chartered Accountant to get money(Have requested many times to come for out of court settlement, never agreed-as her father is a diamond merchant, they are buying each and everyone from clerk to top people) . For attending CC have resigned my abroad job and sitting idle at home since 2008! As my father in law know, they can't remarry her daughter, hence trying to ruin my life!
After all above My wife claim that as per limitation act section 5, should not allow my HMOP petition which is filed in 2007 for concealment and delayed in applying(IX rule 8 of code of Civil Procedure) , How to succeed/take further my case? Is their any citation avaiable, please recommend. Appreciate your valuable advice.
After all these, my father in law had challenged that will not allow me to get divorce till I reach the age of 80!
Have experienced a lot in court for past 3years without job by attending all hearings where had come across:
-Boycott by advocates
-Summer Vaction
-opponent advocate need to come from another location, hence for there convenience time was given/ extended usually 1/2 months
-Did'nt allow POA when i was abroad and out of my 10 request to give on my convenient dates to come from abroad(where i spent lakhs for air ticket and lost major savings in it), got only two times to visit as such. The rest of dates, was compelled to take permission from my ex-employer.
-Whether a man is working or has the capacity to maintain himself not an important issue but when he has applied for divorce, must pay interim maintanance by all means!
Being born as a Man and especially in caste of HINDU is a sin. Iam already 35-don't know how long to wait for divorce, sometimes i feel should take some other step....
