Writ related to RTI and criminal case

Ld counsels,

The public prosecutor office of HC has challenged the information commissions order to give information to me.

The fact of the case is police have manipulated the complaint and the improved allegations in the complaint were not revealed to the court during anticipatory bail hearing. Also in a seperate proceedings information commussion has ordered for departmental enquiry to find on how the polcie gave false information to me. Polcie are not complying to this order.

Now in the writ case will HC apreciate the circumstantial eivdence which is the bail order and other documents supporting my claim Or will it once again order the police to enquire into the manipulation of records before passing the final orders in he writ case field by the PP denying the information to me.

PP's main contention is sec 126 of evidence act but it is not applicable in this case bcos there is an ilegal act committed by police with the knowledge of the office of PP.

So please clarify how the HC will view this case.

Motor Vehicles Act, 1988.

4. Age limit in connection with driving of motor vehicles.

(1) No person under the age of eighteen years shall drive a motor vehicle in any public place:

Provided that 1[a motor cycle with engine capacity not exceeding 50cc] may be driven in a public place by a person after attaining the age of sixteen years.

7. Restrictions on the granting of learner's licences for certain vehicles.

(2) No person under the age of eighteen years shall be granted a learner's licence to drive a motor cycle without gear except with the consent in writing of the person having the care of the person desiring the learner's licence.

(21) "light motor vehicle" means a transport vehicle or omnibus the gross vehicle weight of either of which or a motor car or tractor or road-roller the unladen weight of any of which, does not exceed 2[7500] kilograms;

Query:

1)As per section 7(2) of the aforesaid act it has been mentioned that on the day of majority means 18 years of age or after that day means after 18 years of age he person can get the learner's licence than there is a dought that as per the Section 4(1) of the act if the person is of 16 years or after that day means after 16 years he can driver 50cc vehicle in public place. so as per by understanding from the age of 16 to 18 years of age (excluding the day on which the person became's a major i.e. 18years)he doesn't reqiure a learner's licence. Becasue section 7(2) says No person under the age of eighteen years shall be granted a learner's licence to drive a motor cycle.& Section 4(1)says [a motor cycle with engine capacity not exceeding 50cc] may be driven in a public place by a person after attaining the age of sixteen years. So whether to take the learner's licence or not for driving the 50cc vechile in public place.

Pls direct me.

2)Pls explain me the meaning of omnibus & unladen weight.

3) what do u mean by punitive damages as per the contract act, 1872. Ps explain in detail if possible with the help of example(S)(S)(S).

Thanking u all experts in advance.

Credential of work done

Sir/Mam

A contractor has done work with our department under sub-contract agreement by obtaining due permission from competent authority. Now the contractor is submitting his work which is done on sub-contract basis as credential for a new tender. The relevant clause of our contract condition is furnished under:

Assignment of Subletting of Contract:
The contractor shall not assign or sublet the contract or any part thereof or allow any person to become interested therein any manner whatsoever without the special permission in writing of the Railways. Any breach of this condition shall entitle the Railways to rescind the contract under clause 62 of these conditions and also render the contractor liable for payment to the Railway in respect of any loss or damage arising or ensuing from such cancellation. Provided always that execution of the details of the work by petty contractor under the direct and personal supervision of the contractor or his agent shall not be deemed to be subletting under this clause. The permitted subletting of work by the contractor shall not establish any contractual relationship between the sub-contractor and the Railway and shall not relive the contractor of any responsibility under the contract.

Under this circumstance please suggest me whether to accept the credential submitted by the Sub-contractor or not
