Entrance Exam to Practice Law

(Querist) 18 June 2010 This query is : Resolved
I need to narrate the following case for our experts to offer an authentic opinion:

(a)a student who underwent two years regular study and gained a law degree (BGL)
(b) and later on pursued with a ML degree through correspondence course and successfully gained a masters' degree

(c) He is employed in an organisation and his employer gives NOC to appear for the exam.

Whether he is entitled to appear for the proposed entrance exam to qualify for law practice?

Mr.Parthasarathi Loganathan,

In my considerate view there is no estoppel for working person to appear in the enterance examination for the purposes of qualifying for law practice.

It is important to bring in your kind notice at this juncture that it has to be crosschecked and verified as to whether the mentioned two year law degree is being recognized by the BCI (you have not mentioned the year of qualifying the exam and whether this two year degree is validated duly by UGC) Secondly if the intention is to continue with the employment (meaning thereby to keep the grant of licence for practice in abeyance) in that eventuality I have my doubt that this will be allowed (as there is no precondition for appearing in the exam to best of my knowledge).

I hope your query is amply answered.
Best Regards
Daksh

@Mr Loganathan : i am not sure but i guess 3 years of regular LLB is required for practice in the court of law .. pls check with your university if they can allow you direct entry into the 3rd year of LLb .. If yes then you can complete the third year and then apply for a licence to practice

Thanks Dakhji and Pankajji....
Yes since this qualifying degree was gained from the reputed University of Madras, BCI must recognize the same as the student underwent two year study as a Regular Day scholar from Madras Law College. Yes, BCI should consider the candidature of existing employees and award license to practice pending resignation from employment as it would help many law graduates to involve in this noble profession. I would like to request Mr.Pankaj and other experts in this forum to advise as to which university / college in and around Chennai / Chittoor which admits candidates directly to Third Year LLB based on BGL Degree?
