A portion of agricultural land was sold to a builder by the owner. The buyer demanded an approach road and this was provided out of the remaining land by the owner and a seperate sale deed was registered in favour of the buyer for approach road, which means the buyer gets exclusive right of use of approach road. Now the seller has a very small width of land as approach road to his remaining portion of land where it is not possible for a four wheeler to enter. Now the buyer has expired.
What should the seller do ? What are the options available ? Can the seller enter into an agreement / MOU with the legal heirs of the buyer for common usage rights. If so, what is the validity. If registered, can it be revoked at a later date. PLEASE ALSO PROVIDE A DRAFT OF SUCH AN AGREEMENT. Is it right to call it an MOU ?
Thanks.
Raja.

Hi,
My grandmother purchased a property and she died intestate. She had 4 children i.e. 3 sons (A,B, C) and 1 daughter. The daughter gave up her share vide a relinquishment deed in favour of A, B and C. The property was mutated in the name of A, B and C. Thereafter a family settlement was entered into where A was entitled to 20% of the property (i.e. 1 floor) and B was entitled to the remaining 80% of the property (i.e. 4 floors) as C had relinquished his share in B's favour. This family settlement deed was registered with the authorities. The banks are refusing to give a home loan on the basis of the letter of mutation and family settlement deed citing that this does nto confer a clear title to A and B.
Please advise what other documentation can be entered into so that the title of both the parties is recognised and what will be the total expenditure.

Whether Owner of an Immovable Property situated in India, residing abroad , can gift
that property by giving Power Of Attorney to
an Resident Indian ? If yes , whether the settlement can be made to anybody , or to only a close blood relative.

Dear All,
If one of the siblings file a declaratory suit seeking declaration about his/her share of the property whether the same amounts to the partition of the property?
Awaiting your response eagerly.

Dear All,
I would like to request your indulgence in answering my query pertaining to the rights of a Hindu Widow in succeeding in her husband's self acquired property - whether the same gets devolved absolutely or she has to share it with other children if any.
Thanking you in advance.
Best Regards

property dispute
Dear Sir,
I a 44 years muslim from Goa. working in Gulf.
my father died 8 years ago. We lived and still in our LATE grandfather (my father's father) house for over 55 years. the house is worth 1 crore.70lacs. My grandther had 5 sons & 2 daughters. All 5 sons and 01 daughter have died. Grandfather did not make any will.
Now the grandchildren ( uncle son's & aunty son) are asking us to vacate the house as they want to sell and take their shares which they say the money will be equally shared for amongl the 5 sons + 2 daughters. My aunty's sons and uncle sons (my cousins) are threatning by saying if we do not agree to sell the house they all will come and live in the same house in the same rooms which is in our possesion for over 55 years.
We do not want to move or sell. In this case can the cousins ( my uncle & aunty's children ) force us to move or enter into the house and begin to live in our rooms forcibly.
What is our right.
My mother is now 70 years old threatned by my cousins everyday . Can they threatened her.
If we are ready to sell what % of the share we must demand ?
Most importantly, can anyone force us to agree for sell ? What is our right now on that house.
I gave them an option that I will buy the house and give each one of them 12 lacs each. they do not agree to this.
Please advise. PLEASE HELP
With best personal regards,
A.Sheikh
