Bail

My parents took a arresting stay in a 498A case filed by my wife and I am on a regular bail. The arrest stay is valid upto September and the chargesheet has not yet been filed.

what should be our time of applying for a regular bail as the arrest stay from Allahabad court is subject to mediation centre clause and would expire in september.

The bail need to be applied in the lower court and if its rejected than can be applied with district magistrate. At the time on the day of my arrest when my bail was applied with lower court it was rejected as the lawyer had told me in advance the lower court do not grant bail in these sections 406, 3/4 dowry prohibition act and 498A and its likely to be rejected than later I got bail from DM.

I have a question will my parents also not get bail from the lower court and will it be rejected or this happens with the main accused only.

Please help with answers the case is subject to UP Jurisdiction.

will

A (a husband)has a joint( self acquired )property with his wife B. The property is a Society Flat purchase thru GPA in Delhi. The share between both of them is not specified that means both 'A' and 'B' are equal partner. 'A' wishes to make a will of his share in the said property in favour of one of his sons 'C'.
Now the question arises.
1. Can 'C' being a legatee be the Executor of the Will.
2. Can 'C' himself become a witness in the Will.
3. Can'D'(wife of 'C') be one of the witnesses in the Will.
4. Is there any time limit for filling application for grant of probate after the death of the Testator.

Loan given to a friend refusing to return the money

Respected Sir/Madam

I had taken a loan from a bank against my property for the purpose of developing the same property.A friend had helped me to get that loan, there by gaining my trust. Now since i did not need the entire loan all at once since the property is built in phases and the payments are also made accordingly, this friend suggested that we give 40% of the loan amount to the bank and save interest.so he took a cheque from me in his name and later told me since the bank was giving less interest,I have given the money to a private party for 6 months,so i asked him to give me receipt on a plane paper with details of the cheque. After 6 mnths he said that the party has vanished with the money and he will give the money to me once he catches that person. Now what can i do can i go to court and if I can, is it any use.It is a very big amount and I am paying a lot of interset on it.It is going to be 2 yrs since i gave him the money.

Thanks and Regards
Vishal
