Ownership By way of Possession

Many persons are co-sharers of a chunk of gair mumkin agricultural land falling within abadi deh and one person X (not a co-sharer) is occupying a plot of 400 Sq. Yards out of the joint Khewat since last more than 20 years hostile & open to the true owners. Now one co-sharer has executed an agreement to sale in favour of a stranger mentioning in the agreement that X is occupying the land under agreement and vendee shall have to get its possession from X and vender is not responsible for eviction. That stranger visited X and threatened to vacate the plot as he has purchased it and registered sale-deed is going to be executed within next days to come.

In the light of above-noted facts, what options are available with X?

power of jmfc court in recovery from husband and husband has applied in high court.

most humble request to lawyers-

recently session judge has cancelled the appeal of husband for stay order against interim relief to wife passed by jmfc, husband has applied in high court against jmfc and session judge order agaisnt husband to pay xxxx amount to wife.

during this pending time husband didn't deposited amount as he does not have any amount balance to pay in physically but the interim relief amount is gone upto rs. 100000/- now wife has filed for recovery application before jmfc but yet high court order is yet to came. and jmfc court is making pressure on husband to pay interim maintenance to wife or produce high court order for stay for the same. and further wife applied for issue of NON BAILABLE WARRANT against husband.

query to be replied for -

can a jmfc court take action against husband where husband is in appeal procedure and the same is pending before high court.?

is there any bar on lower court where appeal is pending before upper court? any case law to curb jmfc monopoly to execute order issued by them but yet appeal judgement is yet to come.?

what step can i take in this dilemma where jmfc is not considering all false allegation made by wife in d.v. case of maintenance and the financial position of husband as actually he is not in the position to pay heavy amount.?

Rrevision against ex parte order

I am advocate. In an application under section 125 cr.p.c magistrate passed a final ex parte order against husband on account of his absence after he put up appearance on being served. The order is under Proviso to S.126(2) cr.p.c & dated 15.4.2011.Respondent's advocate did not file application for setting aside ex parte order in the same court but file revision before SJ (u/s.397 cr.p.c)on 01.8.2011.
WHETHER THIS REVISION IS MAINTAINABLE ?
If YES, How?
If NOT, Why?
Please guide....Thanks in advance
