Section 138 N. I. Act

I entered into an agreement with the landlord to develop the land and construct a multistory building thereon, as such according to agreement I have given a cheque of Rs.2,50,000/- to the land lord in consideration thereof, but in the mean time the landlord did not supply me the Original documents relating to the said land because there was no provision agreed in agreement to supply original documents as such I could not able to get sanctioned the plan and could not construct the multistory building, mean while the landlord got the aforesaid cheque dishonoured and filed a criminal case U/s. 138 of N.I. Act, am I liable for punishment U/s. 138 of N. I. Act, if not please suggest me with case law.riven

Information regarding filing M.A during the pendency of O.A

Dear Firends,

I need an information from those who are practisng in the CAT. If an applicant files an MA(Miscallneous Application) during the pendency of the O.A(original Application), Please inform that M.A will be listed separately or only on the date of next hearing when O.A will be listed?

Criminal Complain after Filed Civil suit

First i have submited Civil suit for the 1996's agreement's Specific Perfomance aftr that opponent has filed the Criminal complain against to me that the agreement of 1996 is fraud and i had made it myself.

So now police has been searching me and i have filed also anticipatory also high court and has rejected so now wht should i do?


Is there any provision that when the civil dispute is running so till the judgment of civil suit the criminal complain will stop or stay?

Maintenance part to divorced woman + kids

I would like to know whether any maintenance to be paid to my wife + kids -2, after divorcing her as she is always pressurising me to stay with her parents in their bunglow or near to them which is not acceptable to me.

She has one younger brother studying in 12std and another one working in Gulf.

If she, on her own, plans to stay with her parents, then why should I pay maintenance. It is like, if husband become sick / jobless for few months, she will leave for her paretns place and then demand for maintenance. How it is possible in such situation.

Pls explain to me.

dismissal from service

one person working in central govt. and lost case in thelower court.and sentenced. he went to high court and got stayed the lower court decision. no departmental enquiry was conducted.in the meanwhile, he was dismissed from service. under banking regulation act 1949. shall he get employment till the decision of high court. shall he is eligible for going to supreme court after high court how shall he get employment in the mean time what is the proceedure to be followed. please help him

Liabalities of Father

Dear Experts,

Please help me on problem. The story is

We are 3 brothers and one sister. My 2 elder brothers (Married) are working in ONGC and i (Single) working in Delhi.

Recently my father passed away. He had liability of 4Lakhs. He has neither given any property us nor no property on his name and my mothers' also.

Kindly advise me his liabilities are to be borne myself or not applicable to us.

What does Act mean?

What does"(amendment)'Act'" really mean in:
eg: CPC (46 of 1999), (22 of 2002)
Central sale tax Act,1956(74 of 2004)etc.
What meaning do 46,22,74 carry here?

138 negotiable instument act

Hi
1. I want to know that if an account is in the name of a person as e.g. " Gandhi, HUF", then can a person in his individual capacity as Gandhi file a complaint u/s138? The payee will be " Gandhi, HUF", rt? not only Gandhi?
2. If Gandhi, HUF is not named as the complainant then can it be said that complaintant Mr. Gandhi has no locus standii to file complaint? what are the chances of acquittal for accused?
3. Can anyone provide citation to help accused?
