Paid holiday in case of 5 day week

In case of 6 day week, paid holiday is on seventh day. If one works for 26 days, he gets months salary. Then what above 5 day week, pay day.

Age limit for an employee in private sector?

dear Experts,

this regarding age limit for an employee working in an organisation. we have an employee with age 60years working for our organisation. recently he asked our managemnt to provide ESI voluntarily, and his salary is lessthan 15000 rupees. as per ESIC act he is eligible for ESI Facility. but our organisdation feels that he is senior citizen, so he shouldn't be employed as per law. my query is, is there any age limit in private sector? does it becomes wrong if we deploy senior citizen in work? please suggest me........

What all does vda include?

Dear Sir/Madam,

Am working for a Pharmaceutical Industry. Our organisation employs for more than 200 staff/workers. Our salary break-up includes Basic, HRA, Conveyance and Special allowances. but i heard that break-up can be given as Basic & DA. Am I right? or else please let me know what all can be inculded in DA.Is it Mandatory in giving break-up for the salary? please suggest me and do needful.......

Promotion denied

sir

The judgement delivered by High court, delhi reads as follows:

.... Direction is issued to the respondent to reconsider the case of the petitioner by holding review DPC and if found suitable for promotion, the petitioner be accorded promotion from 1.7.98. we are informed that the petitioner was subsequently given promotion w.e.f.1.7.2001, he shall be given arrears on repromoted post from 1.7.98 to 30.6.2001 and shall also be entitled to consequential benefits of seniority and promotions etc.

The department called me to appear before the Reveiw assessment board 1998 to brief my work report and not to appear for interview/assessment. I appeared before the review board on 27.9.11

the recommendation of the Review Assessment Board 1998 has come and the recommendation is "not yet fit" for promotion.

The review assessment board went beyond its jurisdiction and overlooking the office letter assessed me and gave its recommendation.

Is there any hope left in this case
in light of the following rules .
I may add i have received two promotions one in the year 2001 and another in 2007. both have to be shifted back from 1998 and other on 2003.

should i give representation to the department or directly file contempt of court. has the review assessment board done wrong or not.

supension of public trust employee

a public charitable trust permanent employee has been suspended in karnataka. as per act the trust is covered under shops and establishment act of karnataka. now the period of supension is more than 200 days and management is giving only 50% salary.pl clarify :
1. is employee is eligible for full salary after nintey days of suspensio.
2. enquiry has been closed but no decision taken and employee not informed.can he approach high court for reinstatement.
3. the notice and chargesheet have been issued under education act,where as employee comes under shops and establishment act.
what are remidies available to employee and are there any similar case references

Study leave without pay

sir...on behalf of my friend.
my friend is a primary teacher, currently working in birbhum, west-bengal. he is serving from july of last year, its been one and half year of his service. now he want about 3 years of leave, as study leave without any pay. he ask this query to the chairman of the school council,but did not get any way out.he has been told to resign from service if he want study leave.and told that the govt has been changed ,therefore the existing rule has been changed. he is totally confused, he does not want to resign but to seek 3 years of study leave.please provide a way out. how to get the leave legally . thank you.

Advice in matter of suspension after sentence declared by court

Sir, my friend was cought red handed by ACB and after that Bank Management suspended him and issued him chargesheet and punished him to lower scale.
After that Hon. court sentenced him for five years. He got bail from High Court of Gujarat. He was in prision for 20 days. After getting bail he was released from Jail. He resume his duty. Bank has suspend him. after some time he is issued show cause notice by the bank management why he should not dismissed from Bank service.
Sir, in this situation what to do. High Court has admitted his appeal against lower court's order i.e. imprisionment of 6 years, it is pending for disposal in high court.
Please guide me.
