Cheque dated 1998

Dear sir

1. I joined M/S MSIL Palam Gurgaon Road on 22.10.1990 as 'L-03 Technician' and was confirmed in that capacity on 01.11.1991. During the tenure of service my work and conduct remained good. Due to some unfortunate happening I was convicted for murder by session court thus my service was dismissed on 28.06.1996, finally the order of dismissal was converted into an order of termination on 21.12.1998 by paying me one month pay and retrenchment compensation.

2. Thus, I was sent a cheque dated 21.12.1998 for a sum of Rs 83,226/- being notice pay as well as retrenchment compensation.But in appeal in high court,i was acquitted and I put an application for reinstatement in service.Finally I was awarded Rs 4 lac over and above what is already paid.As I was suffering from sheer depression and other family critical condition, I was unable to present the said cheque in my bank therefore that cheque remained as it is means not encashed.This cheque is with me.How I can claim a fresh cheque fronm maruti.pl advise

Joining in new psu

I friend of mine was selected in central public sector enterprise through on the post of Asst Engg (Trainee). He was kept on probation for two years. According to service contract of employment either party can terminate the contract by serving one month notice or pay of one month in place of that and it was govern by central civil services 1965 rules service condition was under central civil service service rule 1965. But after joining that time due to serious family problem he came to home and send my leave application to my place of posting. But they replied him to join duty . Due to serious family he again ask for leave but they replied him that this was final warning to him and join immediately otherwise they would start disciplinary action against him. But due to compelling family situation he couldn't joined. After this 10 months have passed and the company has not send any further letter to him. He also did not approach the company due to fear of disciplinary action. Now a other PSU has released waiting list for their organization recently . he declared successful in the waiting list. he had applied and appeared in the interview of this PSU much before joining this organization.
I want your valuable suggestion on following queries.
1) Can he join this new company as he appeared for interview much before joining in his organisation? and waiting list has released recently.
2) Since the company has not send any letter after final warning will it be assumed that his service would have terminated?
3) what is the correct way for joining in this new psu?
Pl give your valuable advice.

Most urgent - clarification in pf act regarding salary structure

Hi Experts,

Kindly let me know how much percentage of gross should be shown as basic salary for an employee as per the PF act? Is there any clause under the PF act which specifies this?

Suggestions for making some change in the writ petition (civil)

I have filed a civil writ petition after my termination from service in the Hon'ble High Court and I have mentioned erroneously my office as State in the W.P. by quoting article 226 of the Constitution of India. But now I got to know that my office is a fully autonomous body and I want to insert in the WP as 'fully autonomous body'. Please consider to answer my following question: -

(a) Can it be possible to change my Office status from 'State' to a "fully autonomous body".

(b) Is there any chance for dismissal of my Writ Petition, if I make a request as mentioned at (a).

Please help

Back wages

Dear Sir's

I am Amarchand Khatik working in The Cotton Corporation of India Limited. The Corporation was terminated from service on 13/08/2010 than I was goon to Bombay High Court to admitting petition in Bombay High Court challenging the termination order passed by the Corporation.

Hon’ble Bombay High Court have given order to The Cotton Corporation of India Limited in favour of petitioner to reinstate in Services without given back wages.

I want to know that my salary of termination to reinstate , how many possibilities reimbursement From to The Cotton Corporation.

I hereby enclosing a copy of Hon’ble Bombay High Court order for your ready reference in favour of me i.e. petitioner and what can I do or also shall go to Supreme Court.

Please treat as most urgent.

Bond for regular employees

I was a contract employee with cochin port as a Pilot and had a bond for serving port for 3years of amount rs 180000 shown as cost of training.

Now I am being absorbed as regular employee.
I require no training anymore and I am licenced to do my job.But they are
telling me they will terminate my initial bond of rs 180000 (cost of training) and I have to now sign a new bond of Rs 400000/- as security bond for serving port for 3years.
Bond is to made in 100rs stamp paper require 2 people as surety.

isn't it against bonded labour act for a central govt organisation to do it.Since there is no cost of training now how they came to a vague figure of Rs 400000.What is the
strength of bond in case i have to leave due to some unforeseen circumstances .

Physically unfit may get compensation or not

Respected experts,
In our private company some production worker
became unfit due to some diseases such as
paralysis,heart diseases etc.they have the
unfit certificates by the civil surgeon(Govt).though these are not due to the accidental injury while working. Are they eligible for any compensation or not?
