Differnt norms for contract basis & permanant lecturer

Myself working as contract basis lecturer in a govt. polytechnic college since Feb' 2008 under W.B GOVT Dept. of Technical education. Recently the above said Dept has published a order about pay hike, it is mentioned on that order that who full fill the norms(1st class in B.E./B.Tech) as per AICTE get the benefit of pay hike. I have scored 65% marks in B.E (not 1st class), do not get the pay hike benefit. But for the post of lecturer(permanent post) in Govt polytechnic I have applied, and get the call letter for interview after qualifying written exam after Which is conducted by West Bengal Public service commission. My query is for the same post my qualification does not match for pay hike (contract basis lecturer)it matches for Lecturer(Permanent) why & What to do?

Workmen compensation

Dear Sir,

A lady who was working for last three years in a manufacturing company. She has been injured at the time of work in the company and she is covered in ESIC. HR department is saying that she is working for last 6 months only and she has temporary ESIC card. After lot of affords she has been admitted in the ESIC Hospital and thereafter has been referred to AIMS. Now she is not completely OK and their company has withdrawn their name from the list of contribution employee.

please let me know, what action can be made on company so that she got compensation since she has injury in their back born which can be considered as partial disability.

She has only photocopy of certificate issued by the company to ESIC that this employee is covered under the ESIC by the Company. No she has other proof to be a employee of the Company.

Please help since she is very poor.

Salary delay- advice me please :(

Dear Sir,

Working with an advertising company from last 08 year.Now company facing some fund problem these days.i not get paid salary with mine colleague from the last 04 month.December month we serving notice period.
Company MD said he will clear all dues before we leave i.e. dec 12 end.But i dont think personally tht he will make our salaries clear.

on a safer side pls suggest if there is any low where we can use to get paid our dues it will help us to makeup our mind to go through low to get paid our dues.

Please advice.

Eligibility for gratuity

Dear Sir,

I am working in one of the Corporate company since 25th Feb, 2008.

Would like to know whether I would be eligible if resigned on 30th Nov,2011

I have been enjoyed all CLs, 15 to 20 PLs every year & all Sick Leaves every year.

I would be very much thankful if could reply at the earliest.

Employer asking to submit passport

Dear All
Greetings

I am new to this site.. Now a days some companies are asking to submit passport while joining. I would like to know that is it legal or not ?

If someone submitted passport and company is not accepting his resignation as well as not giving passport also then what to do ?

Recovered of escess drawal of pay and allowances

Respected Experts,

I am an A/T(C)teacher. I retired from service on Superannuation on 31/07/2011.But till date my Pension is not released by the Government.
And on 19/10/2012 I had been served a notice by the government authority for deposit of overdrawn an other allowances of Rs 117491/- through Treasury Challan.

Now question to respected experts are that

1. do above action of concern authority is justifiably.As I am a first generation teacher of my state and during the whole service life i do not claim any things from concerned authority.I do not know when my Pay scale was increased and even if there is any overdrawal then that is their mistake as in my whole service life i did take whatever they give me.

2.Is is justifiable to demand such a huge amount from me who is retired now and what i did earn in my life i did expended that already for family as the pay of A/T (c) teacher is very nominal.

3.Now I do not have such huge amount to returned them so what is remedy for this problem. Moreover if my pension is not clear by the concern authority within a year i may be in position of starvation.
4.Is there any legal remedies for this??

Honoring of cat order

Hello,

Pl advice me on the following:

One of friend approached CAT which gave upheld her application and ordered the Department to implement and pay all the dues within 60 days.The Department went to High Court where the writ petition was not even admitted. Now the Department is contemplating to file SLP in the Apex Court. Pl inform me:
1. Whether she can approach CAT for contempt of court
2. Whether the law provides the Department to approach the Apex Court after being rejected in the High Court
3. If answer is yes what is the time limit for filing the SLP.
4. Is the Dept bound to implement the operative portion of the CAT order and then alone go for SLP

My previous employer denies to pay my salary

Hi,

I am very frutrated my previous employer denies paying my 1 months salary 30000/- for month of july 2012.
I started working for Khandwala security from 2nd july till 1 aug 2012 with in this period i found out the co is not paying salary and several are employee leaving company and he was asking me to do unreasonable works which are not related to me and overworking for all the project in absurd very short period and they are very bad employer and the working condition were bad because of that on 1st aug i approach to director and said i like to resigne and ready to serve notice period first he tried to stop me but after seeing my determination he said i will not pay your salary afetr that i said how you will not pay and you have to pay by hearing that he called security and ask him to throw me out. i never been humiliated and this kind of treatment after my good work he said you have not worked for which you are assigned and thats why you dont deserve any salary.
after four months he replied to my mail and said by resigning after 1 month you company suffered loss becaus they hire new employee afetr 3 months and for that i owe him 2 months of loss and hence you dont deserve any salary and will not be paid any salary and false acuses me of misbehaving with mgmt.

what are my options how can i get my salary i reside in mumbai kalyan.

Please advice i am in dire need of help.

compensation to employee on discontinuance of buisness

my father had tax consultancy buisness and he had one staff member and one peon. he expired last year and i sold the buisness to someone else and he does not want to retain the employees. Gratuity act is applicable to employers having more than 10 employees if i m not wrong. My question is whether i need to make gratuity payment to both these employees and also pay compensation seperately for discontinuing employment as i personally have closed the buisness. How should the gratuity be calculated in such case and is there a compensation liability legally to be paid and if yes how the same should be computed? Please advice
