Claim of gratuity


i am working in an industrial unit for

the last 10 years as clerk in mumbai.

can i claim gratuity after submitting

my resignation letter.

note : it is an unorganised unit.

Bond-reg.

Hi, I am working in a private limited company at the time of interview the company say me that i have to sign a bond for 2 years. It is just for the stability for 2 years with our company and no other conditions will be extra apart from this. When I have joined the company then they said we have to give a security amount cheque against the bond i.e. Rs. 2,50,000/-. Now 4 months back they started to torture me, like misbehavior (talking with abusing), late salary and now they are not giving my my salary i don't know why. I am completely exhausted with current job due to the continuous torture by the MD.

could you please advice if i quit what are the possible legal problems and also kindly advice what to do before goinG to quit.

Centre government has define regular service in S No. 9 of annexure of DOPT OM dated 19.05.2009 on regular service of MACPS(Modified Assured Career Progression Scheme) for the Central Govt. civilian Employee. As per MACPS Regular Service shall be commence from the date of joining of a post in direct entry grade on a regular basis either on direct recruitment basis or on absorption /re-employment basis. Service rendered on adhoc /contract basis before regular appointment on pre-appointment training shall not be taken into reckoning

Essential (1) Bachelors degree in Commerce with Accountancy and Mathematics as subjects

(2) Minimum 5 years experience in REGULAR SERVICE on a post with the nature of work of accounts.
(3) Knowledge of computer applications

My question is if one persion completed 3 years articleship (CA TRAINING) training and mention this training as job experence.IS this training calculate job exp. at the time of shortlisted the caldidate.and is it cover regular service exp.(as mention above in exp.required).

Please also define regular service(used above) defination if candidate come from govt/pvt. orgination

1. What is the difference of directorate pay scale and district pay scale.

2. How one establishment is determined that its employees are entitled to directorate scale or district scale.

dont want to show PF of previous company

X worked with a company as legal advisor at hyderabad for a period of 5 months. During this period, his PF account was opened and money wss deposited by employer and employee. Thereafter he left the job, joined a lawyer, worked there for 1 year. Then he worked as legal officer with a company at UP, no PF was deposited nor his PF account was transferred to this company. Now, he has to join a company at delhi. He has not disclosed that he has worked with 1st company for 5 months as it doesnt keeps good impression on employer.
The problem and my querry is that now the delhi company has policy to deduct PF and deposit in PF account. 1. Would the earlier PF account be traced in process of opening new PF account by delhi compNy.
2. Can X manage to hide earlier PF account and get opened a fresh account.
3. Can delhi employer use this as a ground to cancel the offer of job made to X.

PS. X was trying to withdraw the PF money again and again, he was not able to do so yet.

Fnf clearance from previous organization

Hi

I had left an organization after working there for around 2 years & 7 months in October,2010. I still have not received my dues from them.I am following up with them & everytime they give me the period of 2 months but nothing happens even after that. Now that company has split into 2 & as per my knowledge their financial condition is not good. I am sending continuous emails to them & they dont even reply after 4-5 emails. Please suggest me a solution for getting my dues back. Thank You!

THEY AFTER INSPECTING SECURITY GUARDS WHICH WE HIRED FROM SECURITY AGENCY, INSTRUCTED INSTITUTE TO GET REGISTERED WITH THEM AS A PRINCIPAL EMPLOYER.

CAME TO KNOW FROM INTERNET THAT THIS FIRM IS GOVERNED BY "THE MAHARASHTRA PRIVATE SECURITY GUARDS (REGULATION OF EMPLOYMENT & WELFARE) ACT, 1981. AFTER GOING THROUGH THIS ACT CAME TO KNOW THAT THIS ACT IS NOT APPLICABLE TO EDUCATIONAL INSTITUTE IN Vidya Prasarak Mandal Vs. V.M. Shevade 1999 II CCR 6 (Bombay High Court)

I M TOTALLY IGNORANT ABOUT THIS LAW, MERELY READING THE ACT HAS NOT SOLVED MY DOUBTS AND HENCE NEEDED YOUR ASSISTNACE TO KNOW THE ACCURATE LEGAL IMPLICATIONS.

FAILED TO GET ENTIRE JUDGMENT MENTIONED ABOVE. PLEASE ADVICE WHETHER THIS ACT WILL BE APPLICABLE TO OUR INSTITUTE & ALSO PROVIDE RELEVENT JUDGMENT, IF ANY.
