Claiming interest for belated payment of interest

The controlling authority passed orders for payment of gratuity with interest.But the employer coerced the employee to get gratuity without interest and obtained an undertaking to this effectehile paying gratuity as per order.What action could be taken for the recovery of interest

Service protection

I am worked in DRDO under ministry of defence central government job as senior tech asst for 6 years 9 months from 03-04-2000 to 04-01-2007 with my diploma qualification
i have joined in BEML PSU under ministry of defence from 05-01-2007 to till date with technical resignation and with proper channel
My query is whether my previous service will be protected at my present job

Banking-salary deduction & unequal salary.

I am working in a bank under CTC salary structure . Many employees who are of the same grade and doing similar work are under IBA salary structure and are paid 50% more than what CTC employees are paid. Can we use the equal remuneration act and ask for equal salaries for both CTC and IBA employees in same grade ?

Conmpany not giving pf

Dear Sir/Madam,
I had left my organization on 15/09/2012,but still I have not got my PF form.
I am following with HR & Directors also many times but they not given any response.
They also not given me my PF account number,I had sent lots of mail regarding PF but also not given any response to my mail.


Kindly suggest me on that how I will get my PF.

Maximum panetly on expenses

Dear All, Kindly help me for my ESIC case.
What amount a ESIC inspector can charge for calculating tax for esic assessment.
For example, as per balance sheet if loading and unloading charges are Rs 100000/- so what is maximum amount for this expense on which inspector can put tax for assessment.

Service law rules

The charges framed under IPC before trial court and the charges appearing under the departmental inquiry - the contents of both are one and the same in my case. The evidences which I am going to produce before the court of law as well as the defense I have to put before my inquiry authority is also the same one .

Can I spell out my defense to the departmental inquiry officer, before the completion of Trial ? Will it affect the trial proceedings and later decisions of the court? Will my court case will get geoparadised?

If so, to get a stay through the high court , I may please be provided with related case laws, so that I can go through the same and conclude my decision.

Notice period -not served in full

Hi I quit an indian MNC after serving around 22(3 weeks) days. As per the offer letter i have to serve 90 days of notice period or compenstae the company by paying the company for unserved period . But the company has the right to ask me to serve 90 complete days or compensation.
Company is asking me to serve full 90 days and they are not ready to be compensated. I had clearly mentioned that i was redy to compensate for therest of the unserved days as i was not in a position to continue and serve my full notice period. But they did not agree for it and o had to stop woking there. I returned all the company asset like laptop,ID card, and even drawer keys.
Even i have emailed them with my problems for not being able to continue with them. They insisted to come and join immidiately which i could not.
now i started receiving mails stating that they wouyld consider it as absconding as i was absent at work without prior approval.
They are saying that they would hold back my full and final settlement and no releaving letter will be issued. Please advise.

Proceddings before two forum

Here is the case : During continuation of adjudication proceeding before the State Indusrtial Tribunal, few workmen filed an application for withdraw their claim. Accordingly the Tribunal allowed the application. Subsequently some persons had filed separate claims before the CGIT as the appropriate Govt is the Central Govt. It is seen that some of the claimant's name has not been withdrew from the State Tribunal. management filed preliminary objection stating that dispute cannot be raised before two forum on the same cause simultaneously. the CGIT instead of deciding the preliminary objections, directed the Management to file counter on merit of the case.
Is it legally correct? What further stand can be taken by the Management to get the preliminary objections decided before the case is heard on merit? What is the Legal Provision? Any supporting Citation please.
