gratuity

Sir, I served for 13 years in a trust. I resigned in December 2013 as per the procedure. I received the letter of acceptance of resignation, releiving order, no dues certificate and experience certificate. Further I received a letter stating that the gratuity will be given by RTGS or cheque within a month of my releiving. Now 8 months over no response. I have sent few reminders too. After this I have sent a legal notice. Till no response. Kindly guide me further.

According to CBSE by -laws school should pay salary at least same as paid by the government schools.

Govt. schools are paying according to the sixth pay commission in which different pay bands are mentioned.

1.How to find out the minimum basic which the schools is required to give to clerks, teachers and the principal according to the sixth pay commission?

2.What percentage of DA & HRA should be given?

Am i entitled to study leave if course is thru distance mode

I have been working as a trained graduate teacher(TGT)in a govt. school under delhi administration since august 2011.
i am still under probation.

i am interested in pursuing MA course thru distance education from a reputed university of delhi.

today i gave an application to my vice principal to get her sanction to do this course.vice principal is on extension(after retirement)

the last date for admission is 3rd september.

my VP told me to give an undertaking in application that while doing this course, under no circumstances i will ignore my school duties.i will be fully committed to my job also.then only she will give me the sanction.
i want to know:

1. am i entitled to study leave if the course is thru distance mode?

2. If the answer to the above query is yes,can she refuse to sanction this application if i dont give any such undertaking.?
In that case what shall i do?the last date for admission is nearing.
3. can someone upload the LATEST study leave rules for delhi administration teachers who are under probation and want to study thru distance mode?
4, If i am entitled to leaves, can my school VP and staff keep calling me to school on one pretext or other,in the name of unavoidable school work?

Thanks and regards,

Suspension period to be treated as duty period.

Dear Great Folks !!!

To our earlier discussion in different thread,I need give clear information along with attached documents.

Details -:
1. Judicial custody for 2 days,for 498a
2.Suspended from NTPC JOB.
3.Getting substantial amount during suspension period
4. FIR was quashed based on Jurisdication ground after 7 years
5.Joined NTPC: Suspension revoked and I am Regularised now.

High court judgement (Quash)-:
" Applying the principles of law as aforestated to the facts of the present case and the ratio of the decision of

this court in the case of R.satyamoorthy & ors(supra),the impugned F.I.R registered at Bhubaneswar Mahila PS cas no

24 of 2007 as well as the corresponding G.R case no 439 of 2007 pending in the court of learned SDJM Bhubaneswar ,as

against the petitioner are here by quashed.

CRLMC and the misc case are accordingly disposed of"

Suspension period treated as non duty(NTPC comment)-:

"As disiplinary authority, I am of the opinion that your suspension subsequent to your being in judicial custody was

not wholly unjustified. I have therefore decided that your suspension period shall be treated as " Not on Duty" and

you will not be entitled to get any benefit beyond the subsistence allowance already paid to you."

Information requested -:

1. Request you to please provide some line of thoughts to treat suspension period as duty period.(Please provide some information which I can use for appeal to next level of executives)

2. request you to please provide some supreme court judgement w.r.t it.

Suspension from job show cause notice- reply

Sir/Madam,

I am working in an private firm and I have been served a suspension show case notice (on disciplinary grounds) and have been asked to reply immediately. I have two questions:

1.As the time frame of reply defined is "immediate", how much time can I take for reply?

2. If I am terminated can my gratuity be stopped? I have complete 5+ years in the organization.

Thanks
