I am an Indian, working in Bombay as top management team member with national role of leading European Medical Equipment Company since August 2002. When I joined, the company was of British Origin and in 2007 got sold to another European group. My wife is working with another European Medical Equipment Company since 2004 and also has national role. We got married in 2005.
My company’s holding Group which also originates in Europe has got two more companies in India and now decided to merge all the three companies to form one entity. Out of these balance two companies, One of the company’s product range compete straight with my wife’s company. Last week, newly appointed Managing Director of this new merged entity calls me for meeting and tells me that he finds me the most potential candidate for management team member of new entity and I will get that post only if my wife resigns. He cited examples of code of conduct while conveying his decision. Alternately,if she don’t resign then I have to resign. He has given me one week time to think. I have a documentary evidence of this conversation and can prove in any court of law about his act.
company's code of conduct states that Conflicts of interest: No employee may be involved in an activity or hold a position outside (company name) that is in conflict with the company’s business interests. Such conflicts of interest could also include directorships, significant shareholdings or the employment of family members.
Legal compliance and local customs: (company name) employees must comply with all the applicable laws and regulations of a country in which the company operates. In cases where a conflict exists between more restrictive laws and this Code’s principles and values, the law shall prevail.
Now,
1) how can I protect my deserving position and also keep my wife’s job?
2) Else, what should be my legal stand on such issues?
3) how can i seek fair compensation if i have to leave job?
4)Can I appeal against such acts in European courts (since my present company is 100% subsidiary of European company) for fair settlements if they decides to terminate me.

I was working in a company in noida from past 5 months and on 28-may-16
They told me that we cant continue with you without any valid reason and did not gave me my salary now I am job less were will I go this time I have reaponsibilities on my shoulders what should I do please suggest.

sir a person employed 35 years ago as a labour in PSU, the name of employee at the time of appointment is ragistered as ROHIT PRASAD S/O KEWATLAL DOB 14.04.1958. Later on after 3 years of service PSU issued an notification for promoting there employees if they have required educatuonal qualification, in regard to this above person submitted his educatuonal certificate and promoted as clerk, the name on the marksheet is ROHIT KUMAR SAW S/O KEWATLAL DOB 14.04.1960.
At the time appinting clerk management has not raise any objection and simply promote him as clerk but management also not ractify his record, now after 35 years they demanding eductional certificate again and said me that they didnt have any certificate in there record, i want to know what steps i required to follow, should hedirectly submit ??? What action they can take against him

Hello good afternoon to all experts,
I am working in a private residential school in baroda district Gujarat since last 3.5 years as a teacher.
I was appointed on temporary base for initial 4 moths. After then on probation for next year. After completion of probation period i got confirmatio for next academic session. The school management calling teachers in january for next year contiuation of service. They are taking signature on consent form. I sign that consent form for the current academic session. Meanwhile i got a better opportunity. So I have sent my resignation by email indicating notice period as per confirmation letter. Now my management is telling that you cannot leave the job right now. We will not releive you because you have signed the consent form. Even they said we will not provide you anything from salary to your luguage. So kindly guide me what to do?

dear experts,
I have decided leave my present employer (public limited company) my DOJ was 02.05.2011 and had a training period of 3 month and probation period of 3 months, got conformation as on 01.11.2011,weather i am eligible for gratuity. The company is saying that they will pay gratuity only upon the completion of 5 year from the training period. Is there any possibility as per gratuity rules for me to get gratuity... How can I convince my company for getting me the gratuity?
Kindly suggest/help me in this matter…

Sir/Madam,
My relative is worked in Indian Overseas Bank (Public Sector Bank) in Tamilnadu. She had given the notice period to them before relieving. Its a month (30 days) as per their policy and she served the notice period. She had given the notice at 22nd April 2016 and left the job on 21st May,2016 as 22nd May,2016 is sunday (Holiday). Now the issue is the branch manager wants her to pay 1 month salary and get the relieving letter as she left before the notice period .
While at the end of the notice period, i mean at 21st April,2016 (Saturday)the manager was on leave and her divisional manager told that no need to come on monday. FYI she is yet to receive relieving letter...
Is it possible to file a case to not to pay the extra money?
Any help regarding this would be appreciated

Please advice me whether the following case can be fill on the basis of cheating or fraud against the govt servant who concealed material facts and because of that i am suffering mental and financial harassment.
Case Details:
1. I have been transfered on promotion as per transfer policy to another state. I am handicapped person Thereafter I challange it in H'onble CAT which give direction to me to give representation and tell your difficulty, and department was asked to decide it according to rules.
2. I gave my representation stating my physical disabilities, my family problems and on the basis of Govt guidelines on handicapped i requested exemption from transfer policy and promotion in delhi.
3. My representation were forwarded to the transfer committee of the department in which one official from personnel section take part as member without approval. And on the basis of what he shown to the other members of committee the committee recommended my transfer.
Following are the facts which the official of personnel section concealed which I came to know after court order and joining at another state now:
a) That there were vacancies available in delhi on the date of meeting. He showed only one vacancy outside delhi. Have Delhi vacancies been shown to members of committee I on the basis of guidelines might get exemption from transfer policy.
B) My representation not circulated to outside members present in the meeting through video conferencing.
Due to above concealments i have been transfered and also suffering financial losses and mental harassment. My Govt accomodation got cancelled. family residing on market rent.
Please advise whether against the above official can i file case of cheating or harassment and can claim compensation of losses that i am suffering without any fault of mine?? I have proofs of all above gathered through RTI

Respected Sir,
I had joined Maharashtra Police as a Police Constable on 3.03.2003. Subsequently, I applied for the post of Asst.Security officer at Tata Memorial Hospital through proper channel. I got selected for the same and was relieved on 17.12.2007. Thus I have put up total service of 4 yrs. 9 months and 16 days without any break. Tata Memorial Hospital(TMH) is located at Parel, Mumbai and is an autonomous body under Dept. Of Atomic Energy. After joining TMH i had put up request for counting of past service. TMH had asked Mah-Police dept. to transfer gratuity amount but they denied for the same after taking advice from the Pr. Accountant General (A&E)-1(through Home Dept.). The Pr. Accountant General (A&E)-1 quoted that "Mr. AS Bhosle Ex. Police Constable is not eligible for terminal gratuity as he has served only for a period of 4 yrs. 9 months and 16 days, since as per Apendix II of the MCS (Pension) Rules 1982, a temporary govt. servant will be eligible for terminal gratuity provided he had completed not less than 5 years continuous service at the time of his retirement".
Sir, is their any possibilities of my previous service be counted for benefits. kindly advice.

Hello everyone , A few days back , I resigned from an
organization . I work for a software firm in Bangalore ,
India . I sent my resignation to my manager , cc ' ing the hr
of the company through my company ' s email ID . I have
spoken about this to my manager and he has oraly said
he would acknowledge to the mail. I have 90 days notice
period . now I feel that my manager has some other plans
in mind and he isn ' t ready to acknowledge, going through
few other posts , I thought to reply to the same
designation mail as a reminder and mentioning my last
working day according to the company policy . also I
would like to know if the company can hold me back even
after serving notice . ? any help in this regard is
appreciated. Thank you .
