We have a query which requires your redressal :-
A client of ours is a closely held private limited company. It was established way before independence. Hence, after independence, it registered itself with the provident fund establishment and got the status of exempted establishment for which a separate trust fund was created at that time. The Provident fund contribution gets credited in the Trust Fund Bank Account monthly.
Now many years have passed since the creation of the Trust. Now the Trust deed has been misplaced by the company and it is not available with the Bank or the Provident Fund authority also. Due to KYC compliance issues the Bank is again asking for the Trust Deed (which is not available with the company at present) and had blocked the Trust fund Bank Account.
Other than the Trust deed, other documents are available. The Trust is being audited yearly and PF Contribution is also being made. Only the Master data is missing.
My questions are :-
1. With no reference of the original trust deed being available, can we make a fresh trust deed? (Note :- only one trustee is alive now)
2. If so, how can we make a fresh trust deed so as to submit it to the bank for KYC compliance purpose?
3. Since the money is still blocked in the Bank and no PF withdrawl can be done, what are the legal remedies available?
4. How do we solve this problem?

With reference on the subject cited above, in this connection it is intimated that I have purchased a flat in Punjab after getting sanctioned loan amounting to Rs. 20 lacs from PNB Housing Finance, Chandigarh and the flat is registered in Zirakpur Tehsil Office after paying Stamp Duty and Registration fee as fixed by the Punjab Govt.. At the time of purchasing the flat the Dealer has intimated us that you have not to pay sewerage connection and water connection charges which they have already paid and at present after purchasing the flat the dealer has intimated that you have to pay sewerage and water connection charges in Municipal Office, Zirakpur (Punjab). At the time of built of flats sewerage connection and water connection is already paid by the dealer then why we have to pay these charges on independent basis. This flat is not under the jurisdiction of RERA.
Please advise us. What can I do. Pay charges or not.

Govt.regularized some of the contract employees who are recruited under the same advertisement but in different post in the same dept. Can we claimed the same regularization?.Is this the discrimination?. Are these regularized employees similarly situated employee to the irregular employees .
I am a state governent of Andhra Pradesh employee recrited as gropup II category by APPSC in 2007. Due to personal reasons i hav taken aEOL during 2009 to 2010 which has all been regularised after a lot of representations and fugting for it. I hav been in continuous sevice since then until 2016. But i hav not been given any increments including my 1st increment which is to be given even without probation declaration. I hav been giving many representations ask8ng for release of my increments and declaration of pronbation to the head of the department as well as directorate. But no action was taken.. i hav servied a notice to the finance department warning them that i will approach the court. Now in 2018 1st increment was given but now the file has been stopped again. My probation declaration and subsequent increments are still due. All my batchmates as well as juniors hv been given their due
Sevice benefits overlooking my seniority. As per rule 18[a) of AP state and suordinate rules, my probation is deemed to be declared if no notice is served to me within one year of the completion of the prescribed probation period i. E 2 years. So far no notice or any cominication given me citing my i elig�bility of probation or any other misconduct or wrongdoing of me. Without any fault of mine why my increments and service benefits are stopped.. there is no communication or answer. Simply the are kept pending since years... but i hav been continuously persuading the authorities personally and also through written representations. I was always told that we will do it no action taken. Orally they keep citing the reason that i hav taken leave in 2008 to 10.
I request for expert advice whether i can get back my dues.

I m Delhi govt employee..I HV completed my probation period...in service from 2014...now I HV selected on ESIC on same post under central govt...is there any notice period....my employer asked me to serve three month notice period... I HV not time to serve this...and want instant resignation... employer asking me to pay three month salary..jbki sevice rules notice period ke bare mei silent hai....kya mujhe 3 month salary pay Karni Chahiye

Please suggest me ....we have employed employees on 2 year contract basis as technician. Now contract is over. So we have to pay Retrenchment compensation to employees or not??
Sir my final question If management terminate me giving the reason as violation of policy of cutting 20% salary without any prior notice like if they did on spot termination. Due to this kind termination. Is there any kind of compensation is will get by pledge complaint under any labour policy.

I have been deputed from State Government office to Central Government Autonomous organisation.
In this new organisation, i have been posted 'against an existing vacancy'. What does this mean?
Do am I entitled for all the perks and privileges for this existing vacancy.
This is one higher post than the post I discharged in Parent department of State Government.
Please clarify.

Pleasze guide me the time limit to make confirmation to Employees in the Organisation .
My Friend work in a Pvt Ltd company . They do not confirm the employee till Two or more years ( Even don't issue letter to extend probation Period) to avoid Leave Benefits and other Benefits to Employee , is it correct as per law.
