Respected Labour law Specialist, Kindly advise me on the following issue citing applicable case laws if any :
Labour Enforcement officer( Central) has issued notices to the Local Branch office of a incorporated pvt. ltd. company engaged as an air tickecting agent as well as providing travel related assistance except running airlines or handling air freight , non-compliance of the following Act & Rules-
1) Payment of Wages Act, 1936 & the Payment of Wages ( Air Transport service) Rules,1968 ; and
2)Payment of Gratuity Act,1972 and Payment of Gratuity (Central) Rules,1972 .
Pl. bear in mind that the noticed establishment is duly registered under the state Shops and Commercial Establishments
Act & Rules and properly maintains the
Registers and other exhibits as provided under the said law.
The point in question is whether the notices issued to the establishment are proper and applicable .
recently i had a fight with my colleague in the office staircase...though no body saw it but they've seen us shouting..now the hr is asking me to resign or else they'll terminate me.. what should i do?? if they terminate me , will i get one month salary?

I have problem for submitting July-2010 monthly contribution becasue I forgot to add some employees now I registered these employees on e.s.i. site but not how can I deposit the july-2010 contribution of these employees. Bank only take computer genrated challans from Sept.-2010 in Delhi.
pl. tell me procedure to submit the monthly contribtion of these extra employees of july month.

my service provider used to send me promotional communication. when i enquired,they told me to register in Do Not Disturb.even after i did it, i am getting occasional unwanted smses.when i report to customer care,they kindly advise me to delete those smses; but dont answer my straight question.....why am i getting promotional sms even after registration at DND? can i sue the mobile company??

My wife is a teacher in one of the public school (which runs under minority act) G.H.P.s the school body is not ready to implement the sixth pay commission where as they have charged the increased fee from the parents on the pretext of sixth pay commission payment to teachers please suggest me the wayout of this problem and likly outcome of our action.

I had been working with a leading Private Sector Bank at one of their branches in Uttar Pradesh
In June 2009 I was accused and subsequently put behind bars as an undertrial in a Criminal Case of murder and rape. The trial was concluded in July 2010 and I was acquitted of all charges by the Honorable Sessions Court at Ghaziabad. During the pendency of the trial my employer suspended me w.e.f August 2009.
During the trial the employer paid me full salary month on month. I have now joined the organisation back and have started reporting to work.
Now the HR Dept says that Salary paid to me was an error and the Banks policy does not provide for any salary to be paid under suspension.
They further maiantain that if I wish to continue my employment with the bank and get my suspension revoked, I need to repay the employer, Salary for all 15 months.
This amount is sizeable and I m in no condition to pay this.
Please advise if the employer has the right to make such a demand and what are the legal remedies available to me.
Please also advise if I can be made to suffer for some mistake at the employers level especially when there has been no formal communication to me or my family in this regard
The employer is Public Ltd company with Registered Office in Mumbai
My son is an employee of a reputed IT company in Mumbai. Due to some of his personal committment he has submitted his resignation (Notice of two months)and presently on notice period (this is as per the policy of the company). Now his superior says that he has to work one more month after expiry of the notice period of two months. Can the company extend the notice poeriod ? If no, then what action can be taken against the company. My son is not willing to continue after expiry of notice period. Reply is awaited. Regards.
