Pf applicability.....?

Dear Sir,

We are new start up company Engineering Company covered under Factory Act in Pune - Maharashtra ( Strength - 20 On Roll + 20 Contract Workers )

We want to apply for PF code but the PF authorities are asking that unless we are not having 20 employees on roll we can not apply for the could you please guide me for the same?

Early relieving and salary payment in lieu of early relieving

Dear All,

Currently I am working in a Pvt Ltd Bank for the last 3-1/2 years. My hometown is Jaipur and my family is living there alone. I got an Opportunity to join a new organization who is offering me the same profile and good salary hike and moreover they are providing me my hometown location. As per my appointment letter of current organization, I have to serve 3 months of notice period before relieving or I have to pay compensation in lieu of my early relieving. As per HR I have to take Regional Head approval for early relieving,which is not mentioned in the appointment letter, but he is not ready to give me early relieving and forcing me to complete my 3 month notice period. The new organization is not ready to wait for 3 months. I am ready to pay in lieu of early relieving.

Kindly suggest is there any rule or Act or any legal action that can be taken for my early relieving.

Full & final settlement

Dear All,

On what all grounds Company can hold full and final settlement of the employees?

Is non completion of some assignment is one of the ground?

If yes, what is the way out to get full & Final Settlement.

Can anyone tell me the exact date from which the BOCW Act is implemented in the state of Chhattisgarh. If any rules are made by the state government to this effect, pls share the same, if possible.

Ex employee not settel loan

Our company employee Mr A had taken 50000 On the same month new management set up they insisted to regine Mr A HAS REGINED GIVING ONE MONTH NOTICE . COMPANY SAID LEAVE THE COMPANY IMMEDIATELY. COMPANY GIVEN ONE MONTH NOTICE PAY WHICH WAS ADJUSTED FROM HIS LOAN ACCOUNTS ALSO GIVEN LEAVE SALARY WHICH WAS ADJUSTED FROM LOAN ACCOUNT NOW 17000 WAS PENDING AMT WHICH COMPANY SAID SETTEL IMMEDIATELY . MR A SAID SETTEL WHEN HIS PF AMT SETTLED. BUT HIS PF AMT RECEIPT AFTER ONE YEAR AND FOUR MONTH RS. 76000 HE IS EXPECTED 90000 SO HE GOT LESS AMT . THIS PF AMT DELAYED BECAUSE COMPANY HAD NOT COMPLETED FORMALITY .
AS PF RULES PF CLAIM WILL BE RECEIVING AFTER LEAVING 60 Days which WAS not settled MR A WANT BUY GOLD THAT TIME GOLD RATE 17000 NOW TODAY GOLD RATE 27000. HE SAID I GOT LOSS ALMOST FOR BUYING GOLD BECAUSE OF COMPANY HAD NOT COMPLETED FORMALITY.THAT FORMALITY COMPLETED AFTER THAT MR A HAD E INSISTED TO EMPLOYER. HE HAS RECEIPT AMT LATER THEN WHICH SIX MONTH BACK ANOTHER EMPLOYEE LEFT JOB. ANOTHER EMPLOYEE GOT EARLY PF CLAIM SETTLEMENT .MR A HAS SIGN ON LOAN NORMAL PAPER APPLICATION WHICH IS APPLICATION ADDRESS TO QATAR OFFICE NOT IN INDIA OFFICE . APART FROM COMPANY HAS NO PROOF. WHAT ACTION COMPANY CAN BE TAKEN ON HIM? HE IS READY TO PAY 500 p.M. BUT COMPANSATION OF HIS LOSSES OF GOLD RATE AND ALSO RECEIPT LESS PAMENT . COMPANY CAN RECOVER 17000 FROM HIM OR COMPANY HAS TO PAY HIS LOSSES DEALY PF SETTLEMENT DUE TO COMPAY NOT COMPLETED FORMALITY .

Pay protection policy of punjab govt

Dear Sir,
I wish to know about the policy of Punjab Govt on pay protection. I am about to retire from IAF on 31st Oct 2011 after 21Years and 02 Months of service. My pay scale is 9300-34800 with Grade Pay of Rs 4200. I wish to know whether I would get pay protection if got selected in Punjab Govt job after proper the selection process. I am attaching a file for your kind perusal through which I have applied for the clerical post. The conditions of the jobs are not clear to me in the wake of ignorance of policies on pay protection as envisaged by Punjab Govt or directed by respected courts.

Please advise me.

Salary limit of employees compensation

for calculation of the compensation the salary limit is fixed @ 4000/- or 8000/-
as an Employee who has met with an accident , his age is 50 years & basic & d.a. is 14798/-.
14798 x 60% X 30% X 153.09 (factor )= 407777/- is final amount.( his little , ring & middle fingers are amputed & lost in the accident). In the Gazzete the salary limit has been Ommitted. i.e. the actual salary wages will be counted. kindly advice. Is it correct calculation.

Full & final payment before closing the company

Sirs
kindly advice regarding full & final payment as a company which is running for last 32 years & is being shifted to another place from mumbai.apart from gratuity as per the actual years of services what would be payable to staff as well as workers before closing the factory. what is the procedure of it. Should we inform to the factory inspector , labour commissioner etc. after ward form no. 'M' is must to display on notice board.
please advice the systmetic & legal way
