P.f deduction

Whether a retired Government who is reemployed on a fixed honararium would be entitled to P.F deduction.

Bond for joining port as regular employee

Sir
I was a contract employee with cochin port as a Pilot and had a bond for serving port for 3years of amount rs 150000 shown as cost of training.

Now I am being absorbed as regular employee.
I require no training anymore and I am licenced to do my job.But they are
telling me they will terminate my initial bond of rs 150000 (cost of training) and I have to now sign a new bond of Rs 400000/- as security bond for serving port for 3years.
Bond is to made in 100rs stamp paper require 2 people as surety.

isn't it against bonded labour act for a central govt organisation to do it.Since there is no cost of training how they came to a vague figure of Rs 400000.What is the
strength of bond in case i have to leave in case of some unforeseen circumstances .

seeking outside employment railway employee on probation

I have just joined indian railways as Junior engg (p way ) . I am undergoing one year training in the railways. iam on probation for two years. I want to seek valuable advice on outside employment rules
rules are as follows .
Railway employees may be given 4 opportunities in a year to apply in response to notices of Government Departments/Public Sector Undertakings/autonomous bodies wholly or substantially financed and controlled by Central or State Government except where holding of any such applications is considered justified in the public interest by the competent authority. Applications in response to UPSC advertisement will not be counted against the four opportunities mentioned above.
1) I want to know that is applying to State Public Service Commission is also not counted as UPSC
2)Is service bond agreement get cancelled if employee selected in UPSC OR STATE PUBLIC SERVICE COMMISSION?

resignation from speed post

I was selected in central public sector enterprise through campus selection on the post of Asst Engg (Trainee). I was kept on probation for two years.according to service contract either party can terminate the contract by serving one month notice or pay of one month in place of that.My service condition was under central civil service service rule 1965. But after joining that time due to serious family problem i came to home and send my leave application to my place of posting. But they replied me to join duty . Due to serious family i again ask for leave but they replied me that this was final warning to me and join immediately otherwise they would start disciplinary action against me. But due to compelling family situation i couldn't joined. After this 10 months have passed and the company has not send any further letter to me. I don't want to join again in this company. I want your valuable suggestion on following queries.
1) Can i resign to the company through speed post with one month salary in place of one month salary? and ask for waiving of notice period?
2) How the one month period be counted if i send my resign through speed post i.e will it start from the date written on resign letter or date of booking of speed post at post office or on the date of receiving by the office? Pl clearify.

Premature resignation

sir, my client joined a company in delhi in order to shift his base from mumbai to delhi wjth a assurance from the company that he will be kept at delhi. just after his joining he was transferred to some other city. then he was not paid salary for one and half months, aggrieved by this he resigned from the company. however his appointment letter had a clause that he have to give a six months notice prior to resigning or he will have to pay 6 months salary. now the company is threatening to initiate legal proceeding. the company has also breached the contract by not paying the salary due to which he resigned. what remedies does he have now?

Termination of an employee.

An employee is working in an autonomous organisation under a government department. A termination letter is being issued to him without asking any showcause from the employee. Is it legal? What are the rules to chalange the termination? Kindly help.

Request for suggestion in the matter of writ petition.

Sir,

I have filed a Writ Petition in the Hon'ble High Court in 2009, showing my office (which is an autonomous body) as 'State' i.e. govt. department and made Union Govt. as first party and my office as second party.

Now, my office (autonomous body) has issued an office order to one of its employee showing that my office is in fact is a non-government office.

My question is : - Can I file this office order in the Hon'ble High Court where my Writ Petitioner is alive.

If I file this office order 'where my office has been shown as a NGO' then it can be a cause of dismissal of my Writ Petition from Delhi High Court because in the first stage when I filed the
W.P. I have shown my office as State under Article 226.

I have filed my writ petition in the year of 2009 so will it be possible to file the orders in 2012 (because this office order is issued in 2012 itself).

Can I propose some edition in my present writ petition by making my office as ngo instead of a 'State i.e. Govt. Organisation'.

Please suggest me.

Notice period after resignation

dear seniors/experts;

i have resigned my job on 8th jan 2012, due to salary delay, no proper place to sit or keep records, no increments etc saying last working day on 8th feb 2012 one month notice period.After seeing my decesion of resignation my HODs have convinced me oraly saying of salary revision or other perks. as we are two in the dept after my decesion my asst also has put his paper. but till now no offecial communication has sent to my mail id about the salary rvzn from mgt or HODs. now almost one month 3 days over till date.1)as we are two in the dept, if we both leave is there any possibility mgt will go for legal fight? 2) these are few statutory records we need to update , will mgt take that as opportunity to finger up on us? 3) as we are shifted our office from other location, mgt didnt give proper place to keep the record.after many communication to my HOD.so few records are misplaced /missing.will they this as opportunity to complain on us? 4) can i leave any further wait ?for your advise -thnks
