Compassionate appointment in technical field

my younger brother nishant got the appointment in group c job as tech. in diesel shed on basis of compassionate gorund after death of my father in railway.
he does not have any technical qualification and more than it he is allergic form diesel, petrol and such other things so not being elligible to work there. that why he did not join the diesel shed and we requested to the personal department of firozpur division to change his department from diesel shed to some other department but every time they rejected our reqeusts.
i want to know now what should we go for??
1. my brother does not have any technical qualification so does he elligible to get the appointment in technical department??
2. what should we do as we have the medical certificate of civil hospital about his allergic background as in railways no such medical regarding to allergy conducted??

Contractual payment

Hi All,
A contractor of furniture has completed his assignment and only half of the contractual amount is paid, the company is not paying the rest of the amount.
Where can a contractor can file a suit for his payment dues ?
Does a contractor comes under the purview of labour laws ? or he can file a money recovery suit in the civil court ?

Eligibility as professor

I am working as professor since March 2000. Before joining I worked with ISRO for 22 years (1967 to 1998). September 1998 to Feb 2000 I worked as Asstt. professor.

I.e. I have 22 years R&D experience and 14 years teaching experience, out of which 12 years as Professor.

Presently I am working with SFI Degree engineering college, approved by AICTE since September 2002.

Suppose, for personal reasons, if I want to change the Institute.

Can I be appointed as Professor at some other Institute affiliated with some other University? Though I have 22 years R&D experience and working as professor since March 2000, is formal Ph. D. degree necessary?

Non issuance of experience certificate by previouse employer

Sir, i request you to kindly help me resolving the below query...Myself Tarun Yadav working as Manager Finanace in FCI, had been associated with HDFC Bank for three years then in Feb 2011 i got selected for FCI and put up my resignation to my reporting officer requesting in written that "i have to join FCI with in 15 days thus kindly do all formalities to relieve me before that" he had acepted and forwarded the same to HR of HDFC Bank..now they had issued me several notices stating that i have not informed my absence to the bank and then finally bank has right to terminate me as i had not reported to duty..which was absolutely wrong as i had stoped going after informing them with reason...now even they are refusing me to issue my experience certificate...now problem is this that FCI is asking for the experience certificate as it was desirable for the candidature and compulsory at the time of joining. Sir, now i m in deep trouble as FCI has issued me a Memo for this and HDFC Bank is not issuing me my experience certificate...plz guide me that can i initiate a legal proceeding against the HDFC bank for this...my e-mail id is tarunyadav84@gmail.com....thanking you in advance.

Argue on behalf of employer

mr surat ram,migrant labourer from orissa,was engaged as an un-skilled worker in naptha jharancekri power corporation [n.j.p.c] under a contractor in 1995.on the fatal day while returning from home after taking lunch,he opted shortcut route in prefrence to alternative sub way and that was a blasting zone.There he meet with another worker ramesh,who asked hin to assit for blast prepration.dispite the clear warning written in english not to go in the blasting zone without wearing safety guards,surat ram went there to help ramesh,but unfotunately the both meet with an accident while preparing for blast.they were imedietly taken to igmc shimla.where surat ram dead and one leg of ramesh also crushed which later on amputated.no fincial aid was given to them by contracter as he ran away after abondening the work...in the above case the widow of deacsed and ramesh kumar file a patition for compensation/damages....plz argue on behalf of employer

Compassionate appointment

Mrs Sharma's husband was died in year 2001 ,then her son was only 10 years old so Railways Dept. had given a job as ECRC in Rail. Dept, for which railways Dept called her training but unfortunately Mrs Sharma got Failed in such training. Railways Depart. given her Second Chance and called Her for training again but this this time she was suffering from fever so she could not attend it .Now her son has attained the age of majority so Mrs Sharma applied rail. dept. to give Job her son instead of her .Is it possible?

Company expecting services 24*7 from its employees.

Dear Sir/Madam

Greetings!

I want to present a scenario of telecom business where one of the deptt called BSS demands for working 24*7 without adequate Compensation.

A BSS Engg is expected to receive calls from Network Operations Center(NOC) for 24hrs and simultaneously follow with Technicians in field for restoration of sites(towers).

His day starts with Site Visits and Continously moving to different sites for different activity and he often works for more than 8 hrs in normal circumstances. he then has to make special moves anytime if there is outage on sites even if he has worked for 12 hrs in day but an outage in night means he has to move to site immediately.

And for such harsh Services he is paid a meagre amnt of 15K-20K.What does labour law suggest for such kind of Working Scenario as this is a standard norm in telecom Industry for Field Engineers and can be easily proved in any Court of Law.

P.f settlement

dear sir,
i have resigned from my previous organisation in july 2010 with a notice period of 15 days. notice required was for 03 months, but i got the opportunity to work in U.S so with a short notice i resigned. i inform to organisation that i have total 34 leave balances and i will give one month notice,, rest one month i m ready to pay, but they force me to pay for 03 months. so i didnt piad anything. after 04 months i receive a letter from company saying me to pay 47000 rs. i didnt paid that,,, now they r not allowing me to go for P.F settlements. what shoul i do... pls assist and sugest.

Resignation from the job





Dear Sir,

Iam working as postal assistant(clerk) in post office. I applied for resignation as Iam going to pursue higher studies. But my resignation was rejected by the officials, saying that the staff was shortage. But I have to leave my job urgently as i have to go for coaching for further studies. So what should I do in this situation. Can I proceed legally to be releived from my job
