Procedure to follow while filing a court case by in service government official.

Namaste Sir/ Madam,

One of my colleague has received a legal notice which was submitted to his higher officer alleging him to have demanded bribe. Now , he wishes to file a defamation case against the person who has sent the legal notice.

Please guide what is the correct procedure for filing a case by an in service government official in personal matter, Should higher office be intimated before filing a case , what does CCS rules guide in this regard.

Purchase of property

A govt.servant wants to buy property. For the purpose he should take prior permission from his department or show the purchased property in his Property return at the end of the year.

Experts may kindly guide with respect to Govt. rules on the subject.

Noc, technical resignation

Dear Sir,
I am working in a central govt organization for the last 10 years and I have already completed 10 years of mandatory Bond period. In the July 2010 I had applied for a vacancy by my native State Govt In the Grade pay of 4200 & 4600 and that time I was in the G.P. of 4200, and had intimated to my Head of the Office about my application for the said vacancy and had requested for NOC in due course if needed, because at that stage it was not required.. But due to some accident I forgot to take any receiving from the office & now I have only a photocopy of my intimation application with date of application.
In the mean time I got transferred to another place on promotion in G.P. 4600. In the Dec.2011 the Pre-test was organized after clearance from the court against an writ against the vacancy. That time I intimated and applied for the leave for the said exam and leave for the same was granted. Again in the May 2012 the result of Pre-exam was declared and fresh online application for the mains was invited by the commission. While I was due to fill the form I again intimated about my qualification in the Pre-exam and also requested for the NOC to send it with hard copy of application as It was demanded by the commission. That time I had also intimated that I had intimated it to my previous unit, But despite of all that my application was not even forwarded to the authority to whom it was addressed and was returned to me with comment “ Your application for NOC was considered but rejected because you are already working in the Higher or same grade pay Hence it cant be forwarded to higher authority..” It was signed by the official much lower in rank than the addressee. without any dispatch number. That time I applied for the Mains Exam with an undertaking to produce NOC in due course.
In the month of Jan. 2013 the Mains exam was conducted in very short notice and that time I was on PL and after taking exam I again intimated about my mains exam with request to give NOC, but it was denied to forward the application now for the different reason. This time they demanded the detail of my application to previous place of posting. As I was having the photo copy of the application given in July 2010 to previous posting showing the date I submitted the same to office. Then they sent an querry to previous office to give the detail, but the previous office declared that they don’t have any such information.
On the basis of this now my request for forwarding the application to higher official has been turned down. It should be noted that at the time of intimation to previous office I was not lone to fill the form or to intimate there were two more people who had applied, but no one’s detail was available,
Sir, this is not the first time I have suffered. A few month ago I had applied for a post in other department and my NOC request was not forwarded in the name of having same grade pay, but another person posted at different place in same rank or G.P. was given NOC and he was selected. There is a lot of instances of denying NOC in same Grade Pay and I am having all those documentary evidence.
Now result for the Mains exam has been declared and I am finally selected. Again I have submitted an undertaking to produce the NOC in a month/before joining, But they are not forwarding my application.
What should I do? Can I resign and join my new job and claim my service benefit later on through court? What is the chances of my getting NOC as per rule? Is there any other procedure to make request for NOC or technical resignation? Please guide me to save my service period of 10 years.

Validity of bond

Dear sir,

I was an employee of a medical transcription company here in hyderabad. I joined the company in 2010 and signed a contract for 3 years. I got married recently and shifted to a new place. Due to family reasons, I had to quit the job. I contacted the company regarding the same and they demanded me a compensation amounting to a lakh, which is indeed indicated in the bond that I signed, but I am not in a position to pay so. I have served the company to my best level for all these 2 yrs and 10 months and I am left with just 2 months and 7 days. I requested the company to provide me home based transcription for these 2 months, but they refused to do so stating that if given home based it will be extended by 1 year again. And my contract period is extended by 3 months more stating that I took leave for 3 months in these 3 years. This is ridiculous as I was not paid for my leave of absence either..They are infact ruining my family life ..Are such constraints put by the company valid? I dont think any law forces a person to serve an employer without his or her will. I am awaiting your valuable suggestions.

Eligibility for appearing in departmental exam

Namaste,

I am a central Govt. employee. In our department like other departments Limited Departmental Competitive Examinations are held for various Post i.e.from Group-D to Group -C , from Group- C to Non Gazetted Group B , from Group -B to PSS Group-B .

For all the exams , vacancy for the year is declared & qualifying date for computation of service is considered Ist January of the same year . For example , If exam is on 30.6.2011 , vacancy is calculated for 2011 and date for computation of qualifying service is considered 1.1.2011 (5 years of service on this date).

However, only for Group-B to PSS Group B , vacancy is shown for the previous year & thus , qualifying service is considered on previous year's Ist January . For example , if exam is on 30.6.2011 , only person with minimum qualifying service of 5 years on 1.1.2010 can appear for exam. Is this correct ?

please guide where I can appeal for this as no where I found the rule or rationale behind wasting 1 year of candidates .Is there any rule that different LDCE in same department has different rules ?

Service law on issuance of obc certificate

Dear Sir
I am a resident of City A and my native place is Village B, recently i required a OBC certificate and Authority at City

A refused to issue it to me saying that we do not have any information about your caste so we cannot issue you a caste

certificate, so i moved to Village B, when i reached to Tehsildar office at village they said that i do not posses

voters identity card for village B i cannot be issued a caste certificate but at the same time my fore-fathers have been

living in the village since more than 60 years ago and we also have land records related to it, so to get OBC

Certificate i got the caste details and residing details of my forefathers residing in village from sarpanch of village and produced it in Tehsildar office for caste certificate, finally after lot of nagging i was issued a caste certificate.Now the problem starts that i have applied for a Central Government Job and mentioned my address for communication as City A and permanent Address as my village address City B:
My questions are:
i) Is there any form of canvassing/malpractice by using the procedure i used to acquiring caste certificate?
ii) Verification of caste certificate is done prior to appointment on probation/regularized or after probation/regularized?
iii) Verification of permanent address and communication address is carried by whom in communication address and permanent address

Technical resignation in central govt job

Sir, I am a central govt employee working as LDC and have been selected for Excise inspector. I want to give technical resignation from LDC post because my office had issued me No Objection Certificate for appearing in interview for selected post after 3 month from joining the LDC post. I had applied for the post of inspector before joining LDC. Should I entitle for technical resignation?

Paid weekly off

sir,
in my institute we got labour work through contractor. we pay them remuneration for 26 working day including epf, esic and service tax. whether we have to 4 paid weekly off to contractor also. we are principal employer while the contractor is immediate employer. pl suggest me

Workmen compensation

A person has filed workmen compensation case before the wc forum twice in 2009 and 2011. facts of the case are same in both cases but year of accident alone differs in both cases.

whether it is maintainable? which one is maintainable? how can we challenge/defend him?
