National holday is mandatory or not

Dear Sir,

I'm working in a manufacturing company , we have prepared our public holiday list for year 2014 in which 26 January is not declared as holiday as its fall on Sunday. so by not considering it holiday are we are breaking any law?

Payment of gratuity act

If any employee has already received Gratuity amount as per the MP CCS Pension rules 1976 (Adopted by the department) whether such employee is also eligible for getting the difference of gratuity under the Payment of Gratuity Act 1972.

On my probation period no pf deduction,

Dear Sir,

I have completed 5yrs 55 days service ( 06.11.2008 to 31.12.2013)
Probation period is 1 year without PF deduction. (06.11.2008 to 06.11.2009)
4yrs is confirmed period with PF deduction.(06.11.2009 to 31.12.2013)

Pls tell me whether i am eligible for gratuity.

my company tells that they will consider only 4 yrs and refuse to pay gratuity

pls help me to get my gratuity.

which is correct? ami eligible to get gratuity.

On my probation period no pf deduction, now hr telling that reason to refuse my gratutiy

Dear Madam/ Sir,
MY Service period 06.11.2008 to 31.12.2013

probation period is 06.11.2008 to 06.11.2009, so they are telling on your probation there is no PF deduction so not eligible to consider ur propation period for gratutiy

But total i have completed 5yrs 2 months

Pls help me to get gratuity.

Probation period is eligible or not for gratuity

i have 5 yrs 2 months service in a corporate company, but they refuse to pay gratuity , saying that one year is a propation period so not eligible,
On my probation period they have not deducted any PF etc, rest 4 yrs they have deducted everything like PF,ESI.
Without PF deduction Probation period will consider for gratuity

Intimating current employer for appearing upsc and maharashtra psc prelims exam

Dear Sir/Madam, I am working in central govt department on Group B non gazetted post from 6+ years. I joined on the basis of Diploma in Engineering. During the service, I have completed graduation (B.A.) through distance learning mode from open university. I obtained this degree without knowledge of current employer i.e. it is not included in my personal file. now when I approached to my office to intimate that i'm going to appear for MPSC (Maharashtra) state services prelims, they told me that they can't accept intimation as minimum eligibility i.e. graduation, is not in the records. Please note that MPSC has same procedure for application as that of UPSC CSAT. Thanking you.

Change in surname if education continued after marriage

My mother continued her studies upto intermediate before her marriage in the year 1979, with her maiden name as NEELAM KUMARI.
After that she got married, and continued her education.In her Graduation and Teachers training she enrolled herself with her husbands surname as NEELAM CHOUDHARY and her certificates are with her husbands surname as NEELAM CHOUDHARY.

She has been working as a State Govt Teacher since almost past 2 years.

Now her DDO has raised an objection for change in name, ie, Neelam Choudhary Vs Neelam Kumari.

She had not obtained any Affidavit or used any other wway for legally changing her surname, as the college authorites didnt ask for these documents.


Now please guide us as how to deal with the situation,
Is she legally right to continue her job, or not/ what steps need to be taken to deal with the situation.

Please guide us.

Difficulty in getting my bonus.

Hi..!! I joined an investment company. It was clearly stated in my offer letter that on completion of one year i will get my bonus..which was part of my salary only...
I completed a year on 5-nov-2013 and I left the company on 20-11-2013. I was told that i am entitled to the bonus since i have completed a year. I was continuously following up with the HR. For a month, they were like it will be released in a day or so. But suddenly the HR is saying that they have hold the payment because it has been decided that I am not entitled to bonus since I resigned. Please tell me how to move forward in this matter.

Pension rules

Sir,
"A" married with a lady "B", whose husband was alive. "A" entered "B"'s name in his service record also.

Later due to bad character of "B", "A" left "B". "B" filed 125 against "A". Court refused to grant maintenance as her husband was alive while marriage with "A".

Now "A" Married with "C".
But "C"'s name is not in service record. after the death of "A". Asam Rifles is paying family pension to "B".

"C" applied for pension refering the judgment of court, but Asam Rifles is refusing to pay to "C" as her name is not enrolled in record.

Please refer concern rules I have filed declaratory suit on behalf of "C" for declaring her legal wife of "A" Asam Rifles is a party which is stick on it's version.

No response for the pf withdrwal

Hi,

I have sent my PF Forms to the previous employer but employer does not have any intentions for submitting it at PF Office.Employer is not responding after several reminders?Please suggest?
